Stepp, a single person, herein called "Stepp" and Ronnie N. Schmit and <br />Patricia A. Schmit, husband and wife, herein called "Schmit". <br /> <br />WITNESSETH: <br /> <br />WHEREAS, Stepp is the owner of the following described real estate located in <br />Hall County, Nebraska, to-wit: <br /> <br />See attached Exhibit "A"; and <br /> <br />WHEREAS, Schmit is the owner of the following described real estate located in <br />Hall County, Nebraska, to-wit: <br /> <br />See attached Exhibit "B"; and <br /> <br />WHEREAS, a sewer line commencing on Schmit's property and continuing <br />through the Stepp's property is utilized by both Schmit and Stepp and is more particularly <br />delineated on the attached Exhibit "C"; and <br /> <br />WHEREAS, Stepp is agreeable to giving an easement for ingress and egress to <br />Schmit for the purposes of maintenance, repair, and replacement of the sewer line together with <br />the right to utilize vehicles of any kind and description to fully implement said easement for the <br />purposes set forth herein. <br /> <br />NOW, THEREFORE, in consideration of the recitals herein (which are hereby <br />incorporated and made a part hereof by reference) and other good and valuable consideration, the <br />parties agree as follows: <br /> <br />1. Stepp grants to Schmit an easement for ingress and egress along and to <br />said sewer line for purposes of maintenance, repair, and replacement of said sewer line, together <br />with the right to utilization of vehicles of any kind and description to fully implement the terms <br />of easement granted hereunder. <br /> <br />2. The cost any maintenance, repair and replacement ofthe sewer line from <br />the Schmit's residence to Stepp's residence shall be borne by the Schmits. The cost of any <br />maintenance, repair and replacement of the sewer line from the Stepp's residence to the City <br />sewer line shall be divided equally between Stepp and Schmits. <br />
