<br />EASEMENT
<br />McNelis Development, L.L.C. and MelDor, L.L.C., Grantor, for valuable consideration, hereby
<br />grant, bargain, sell and convey to the City of Grand Island, Nebraska, Grantee, a permanent and
<br />_ perpetual drainage easement to construct, operate, maintain, extend, repair, replace and remove storm
<br />sewers, manholes, pipelines, surface markers and other appurtenances for drainage purposes, upon,
<br />over, along, across, in, underneath and through a tract of land consisting of Lots 12, 13, 14 and 15,
<br />Block 2, Northview First Subdivision, City of Grand Island, Hall County, Nebraska and more
<br />particularly described as follows: Commencing at the Northwest corner of Lot 15, Block 2, of said Northview First
<br />Subdivision, thence on an assumed bearing of S89E05'09"E along said North line of Lot 15, Block 2, a distance of 10,00
<br />feet to a point being the intersection of said North line and the East line of an existing 10 feet drainage and utility
<br />easement, said point also being the point of beginning; thence continuing S89E05'09"E along said North line of Lot 15,
<br />Block 2, a distance of 10,00 feet; thence SOOE23'22"W and parallel to the West line of said Northview First Subdivision, a
<br />distance of 366,03 feet to a point on the North line of an existing 10 feet drainage and utility easement; thence
<br />N89E05'09"W along said North line a distance of 1 0.00 feet to a point on the East line of an existing 1 0 feet drainage and
<br />utility easement; thence NOOE13'22"E along said East line a distance of 366.03 feet to the point of beginning, Said
<br />permanent drainage easement contains a calculated area of 3660 square feet or 0.084 acres more or less,
<br />
<br />Together with the following rights, namely, unrestricted ingress and egress under and across such land
<br />for the purpose of exercising the rights herein granted necessary for the full and complete use,
<br />occupation and enjoyment of the easement herein granted, including the right to excavate and refill
<br />ditches and trenches, to clear and keep clear of trees, roots, brush, bushes, hedges, undergrowth, and
<br />other obstructions from the surface of such tract interfering with the location, construction, inspection,
<br />repair, replacement, removal and maintenance of such storm water drain. Any such utilities and
<br />appurtenances placed upon and under such tract of land shall remain the property of the Grantee and
<br />may be removed or replaced at any time.

<br />The Grantors, for themselves, their heirs, executors, administrators, successors and assigns, hereby
<br />covenant that no buildings, fences, or structures shall be erected or permitted on said tract and that the
<br />easement herein granted shall run with the title to such tract of land and be binding upon the grantors,
<br />their successors and assigns.
<br />
<br />The City shall reimburse Grantor for any costs for damage to Grantor's adjacent property as a result of
<br />work performed by the City within the easement area.
<br />
<br />TEMPORARY LICENSE
<br />Grantor also grants to Hastings Ventures, L.L.C., a Nebraska Limited Liability Company and
<br />Starostka Group Co., a Nebraska Corporation, the right to enter upon the above described land in Hall
<br />County for the purposes of installing a drainage system. Said right of entrance, occupation and use to
<br />continue only during the construction and completion of the above project.
<br />
<br />Hastings Ventures, L.L.C. agrees to pay to Grantor a lump sum of Five Thousand Four Hundred
<br />Ninety and no/100 Dollars ($5,490) for this license. It is understood and agreed that the consideration for
<br />said license is in full payment for the purchase of said license and all damages arising from the transfer of
<br />said property interest and its use for the purposes above set out.
<br />
<br />This license to Hastings Ventures, L.L.C., a Nebraska Limited Liability Company and Starostka Group
<br />Co., a Nebraska Corporation, expires ninety (90) days after completion of the drainage system
<br />construction for which the license is acquired.
