<br />CENTRAL PLATTE NATURAL RESOURCES DISTRICT, a Nebraska Political
<br />Subdivision, GRANTOR, in consideration of Twenty-Seven Thousand and Noll 00 Dollars
<br />($27,000.00) does grant, bargain, sell, convey and confirm unto KEITH H. PIRNIE and
<br />PATRICIA A. PIRNIE, Husband and Wife, GRANTEES, the following-described real estate (as
<br />defined in Neb.Rev.Stat. 76-201) in Hall County, Nebraska:

<br />Lot Three (3), Block Two (2), Ponderosa Lake Estates Fourth Subdivision, an
<br />addition to the City Of Grand Island, Hall County, Nebraska;

<br />EXCEPT THAT Grantor hereby reserves unto itself: and to its successors and assigns a
<br />perpetual and assignable right and easement in the land described below, to construct, maintain,
<br />repair, operate, patrol and replace a flood protection levee, including all appurtenances thereto;
<br />AND FURTHER such real estate described above is hereby transferred subject to the restriction
<br />that there shall be no excavation, trees, shrubs or other deep rooted vegetation, permitted within
<br />Fifteen (15) feet of the base of the levee on or adjacent to the real estate; RESERVING,
<br />however, to the Grantees, Grantees' heirs and assigns, all such rights and privileges in the land as
<br />may be used without interfering with or abridging the rights and easements hereby retained;
<br />subject, however, to existing easements for public roads and highways, public utilities, railroads
<br />and pipelines, situated upon that portion of the real estate described as:

<br />GRANTOR covenants with the GRANTEES that GRANTOR:

<br />(1) is lawfully seised of such real estate and that it is free from
<br />encumbrances, except easements and restrictions of record and hereby reserved
<br />for the benefit of Grantor, its successors and assigns;
<br />
<br />(2) has legal power and lawful authority to convey the same;
<br />
<br />(3) warrants and will defend the title to the real estate against the
<br />lawful claims of all persons.
