200603292 4. Storm Drainage. The Subdivider agrees to grade all lots in the subdivision in conjunction with the development proposed thereon so that storm drainage is conveyed to a public right-of-way or to other drainage systems approved by the Director of Public Works. 5. Sidewalks. The Subdivider shall install and maintain all public sidewalks required by the City of Grand Island when the lots are built upon, and such sidewalk shall be regulated and required with the building permit for each such lot. Sidewalks shall be installed south of Deerwood Avenue adjacent to Outlot B with the completion ofthe street. In addition, sidewalks shall be installed on both sides of lrongate Avenue with the completion of the street. 6. Outlot A. The street on Outlot A shall be permitted as a private street within the City of Grand Island. The Subdivider shall create a property owners association to provide for the maintenance and snow removal of this private street. The City and the Subdivider may enter into agreements for the maintenance of and snow removal from said private street. All such agreements shall be approved by separate action of the Grand Island City Council. Sidewalks shall be installed on Outlot A adjacent to each lot and such sidewalk shall be regulated and required with the building permit on each such lot. Provided the Subdivider builds this private street to city standards and to a set of plans approved by the City of Grand Island, the City may consider accepting dedication of said private street and right-of-way upon the request of the Subdivider. Prior to accepting dedication of said private street, the City will perform an inspection ofthe street. Ifthe City determines that repair or maintenance work is required to the street, the Subdivider will be required to complete such work before the street will be accepted by the City. - 4 -
