S-O <br /> <br />THIS DEED OF TRUST MODIFICATION AGREEMENT made and executed this <br />&~ay of MARCH. 2006, by and between GILBERT G MANNING AND LINDA C <br />MANNING. HUSBAND AND WIFE, hereinafter referred to as "Borrower", and HOME <br />FEDERAL SA VINGS AND LOAN ASSOCIATION OF GRAND ISLAND, hereinafter referred <br />to as "lender", <br /> <br />WITNESSETH: <br /> <br />WHEREAS, Borrower did execute a certain Adjustable Rate Note payable to the order of <br />the Lender in the total original amount of ONE HUNDRED TWEL VE THOUSAND FIVE <br />HUNDRED AND NOnOO ,Dollars ($112.500.00): <br /> <br />WHEREAS, the Note described above was secured by a Deed of Trust with Adjustable <br />Rate Rider dated MAY 23.2002, filed of record in the Office of the HALL COUNTY <br />REGISTER OF DEED'S OFFICE. HALL COUNTY. NE on MAY 30. 2002 in DOCUMENT <br /># 0200205762 in respect to that real estate described as: <br /> <br />LOT TWENTY (20) IN BLOCK ONE (1) IN SOUTHERN ACRES ADDITION TO THE CITY <br />OF GRAND ISLAND, HALL COUNTY, NEBRASKA <br /> <br />WHEREAS, Borrower has requested that interest be converted to a fixed rate rather than the <br />variable rate specified by such Deed of Trust with Adjustable Rate Rider and that the stated <br />maturity date be also hereby modified; <br /> <br />WHEREAS, Lender is willing to convert such variable rate loan into a fixed rate loan to <br />be secured by such Deed of Trust with Adjustable Rate Rider and modify the existing maturity <br />date; <br /> <br />WHEREAS, Borrower and Lender hereby desire to amend the existing Deed of Trust <br />with Adjustable Rate Rider identified hereinabove to provide that it shall continue to secure the <br />presently remaining indebtedness from and after the date hereinafter specified together with a <br />fixed rate of interest rather than a variable rate as originally set forth in such Adjustable Rate <br />Rider; <br /> <br />NOW, THEREFORE~ [t is agreed: <br /> <br />1. Interest Rate and Maturity Modification. Commencing effective APRIL 1. 2006. <br />the indebtedness secured by the Deed of Trust with Adjustable Rate Rider hereinabove identified <br />shall accrue interest at a fixed rate of SEVEN AND ONE HALF percent (7.50%) throughout <br />the remaining tenn of such indebtedness and, notwithstanding the provisions contained in the <br />Adjustable Rate Rider, there shall be no further adjustments to such interest rate. The final <br />maturity of such indebtedness as modified, secured by such Deed of Trust shall be MARCH 1. <br />2026, notwithstanding any other date of maturity which may have been specified in the Deed of <br />Trust hereinabove identified. <br /> <br />2. Continuing Effect. Except as specifically modified by this Deed of Trust <br />Modification Agreement, all other tenus and provisions of this Deed of Trust with Adjustable <br />Rate Rider hereinabove identified shall remain in full force and effect. <br />
