<br />This instrument, made this P day of October, 2005, between Eric H. Lindquist, a member
<br />of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor ", pursuant to a
<br />power of sale contained in that certain Deed of Trust recorded on December 24, 1996 as Instrument
<br />No. 96- 109967 in the office of the Register of Deeds of Hall County, Nebraska, and the Secretary of
<br />the Department of Housing and Urban Development, hereinafter called "Grantee ":
<br />WHEREAS, on July 25, 2005, Eric H. Lindquist, as Successor Trustee, executed a Notice of
<br />Default pursuant to which notice was given to Jesus Loera and Rosa Loera, husband and wife,
<br />Trustors, under that certain Deed of Trust recorded on December 24, 1996 as Instrument No. 96-
<br />109967 in the office of the Register of Deeds of Hall. County, Nebraska, covering that certain
<br />premises described as:
<br />LOT THREE (3), BLOCK TWENTY SEVEN (27), ORIGINAL TOWN, NOW
<br />CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA.,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on July 27, 2005 as Instrument No. 0200507178.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Subsequent thereto, beginning on August 31, 2005, Grantor caused to be published in the
<br />Grand Island Daily Independent, a newspaper having a general circulation in Hall County,
<br />Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and stating
<br />that the described property would be sold at public auction to the highest bidder for cash or certified
<br />or cashier's check, at the lower level lobby of the Hall County Courthouse, lst & Locust Street,
<br />Grand Island, Hall County, Nebraska, at 2:00 p.m. on October 13, 2005. Publication of such notice
<br />was made for five consecutive weeks on August 31, 2005, September 7, 2005, September 14, 2005,
<br />September 21, 2005 and September 28, 2005, the last publication being at least ten (1.0) days but not
<br />more than thirty (30) days prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76 -1008
<br />R.R.S. Nebraska.
<br />Pursuant to said Notice of Trustee's Sale, John McDermott, attorney for Eric H.
<br />Lindquist, Successor Trustee, did at the time and place mentioned in said Notice of Trustee's
<br />Sale, offer said property for sale at public auction, and did sell the same to Wells Fargo Bank,
<br />N.A. for the sum of $46,090.45, it being the highest bidder therefor. Wells Fargo Bank, N.A.
<br />has assigned all of its right, title and interest in such bid to Grantee.
