Spiehs, a single woman, (hereinafter collectively referred to as "Trustor") executed and delivered a certain Deed of Trust dated September 22, 1994 to Glenn Van Velson as Trustee, which Deed of Trust was given to secure the payment of a Note of even date therewith in the original principal sum of ONE HUNDRED EIGHTY THOUSAND AND NOll 00 DOLLARS and which Deed of Trust was recorded in the official Records of Hall County, Nebraska, as Document No. 94-107838 and the beneficial interest under said Deed of Trust thereafter being assigned to The Prudential Insurance Company of America ("Prudential"), as Beneficiary, by an Assignment recorded as Document No. 94-108181. ~'" ~, NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that The Prudential Insurance Company of America, Beneficiary under the Deed of Trust, for and in consideration of One Dollar, in hand paid, and for other good and valuable consideration, the receipt of which is acknowledged, has directed the Trustee and the Trustee does hereby, remise, convey, release and quit-claim to the aforesaid Trustor, all the right, title and interest Trustee may have acquired by virtue of said Deed of Trust in and to the premises located in the County of Garfield and State of Nebraska, described as follows, to wit: Legally described on Exhibit A attached hereto and made a part hereof. To have and to hold the same with the appurtenances and privileges thereunto belonging, free, discharged and released of and from the lien of said Deed of Trust. Provided, however, that nothing herein contained shall in any wise or manner affect, alter or diminish the lien or encumbrance of said Deed of Trust on the remaining part of the premises or property described therein which is not expressly released by this Deed of Partial Reconveyance, or the remedies at law or equity for recovering from the parties liable therefore the balance of said principal sum, with interest, secured thereby.
