Spiehs, a single <br /> <br />woman, (hereinafter collectively referred to as "Trustor") executed and delivered a certain Deed of Trust <br /> <br />dated September 22, 1994 to Glenn Van Velson as Trustee, which Deed of Trust was given to secure the <br />payment of a Note of even date therewith in the original principal sum of ONE HUNDRED EIGHTY <br />THOUSAND AND NOll 00 DOLLARS and which Deed of Trust was recorded in the official Records of <br />Hall County, Nebraska, as Document No. 94-107838 and the beneficial interest under said Deed of Trust <br />thereafter being assigned to The Prudential Insurance Company of America ("Prudential"), as Beneficiary, <br />by an Assignment recorded as Document No. 94-108181. <br /> <br />~'" <br />~, <br /> <br />NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that The Prudential Insurance <br />Company of America, Beneficiary under the Deed of Trust, for and in consideration of One Dollar, in hand <br />paid, and for other good and valuable consideration, the receipt of which is acknowledged, has directed the <br />Trustee and the Trustee does hereby, remise, convey, release and quit-claim to the aforesaid Trustor, all the <br />right, title and interest Trustee may have acquired by virtue of said Deed of Trust in and to the premises <br />located in the County of Garfield and State of Nebraska, described as follows, to wit: <br /> <br />Legally described on Exhibit A attached hereto and made a part hereof. <br /> <br />To have and to hold the same with the appurtenances and privileges thereunto belonging, free, discharged <br />and released of and from the lien of said Deed of Trust. <br /> <br />Provided, however, that nothing herein contained shall in any wise or manner affect, alter or <br />diminish the lien or encumbrance of said Deed of Trust on the remaining part of the premises or property <br />described therein which is not expressly released by this Deed of Partial Reconveyance, or the remedies at <br />law or equity for recovering from the parties liable therefore the balance of said principal sum, with interest, <br />secured thereby. <br /> <br />Witness the due execution hereof on this 22nd day of December, 2005. <br /> <br />By: <br /> <br />~~~ <br /> <br />. <br /> <br />Trustee <br /> <br />Revised November, 1998 <br /> <br />.. _tJ?tN:otJ~t1Yfm <br />
