<br />200600404 <br /> <br />between Faustino Gutierrez and Rosario Gutierrez, husband and <br />wife, as Trustor, John W. Herdzina, Attorney at Law, Trustee and <br />A&S Mortgage Services Corp. dba Residential Mortgage Svcs, as <br />Beneficiary, wherein the Trustors granted and conveyed to such <br />Trustee, on the Trusts therein expressed, the property <br />hereinabove described to secure, among other obligations, the <br />payment of a certain note and interest described in said Trust <br />Deed according to the terms thereof and after the fulfillment of <br />the conditions specified in the Trust Deed authorizing this <br />conveyance by reason of a breach and default by the Trustors made <br />under the terms of said Trust Deed in the particulars set forth <br />in the Notice of Default filed by the Trustee, which default <br />continued until the time of sale at which sale the property was <br />sold to the highest bidder, the Grantee herein, following notice <br />of sale as required by law. <br />The Trustee, at the time and place of sale fixed as <br />aforesaid, then and there sold, at public auction, to Grantee, <br />who was the highest bidder for the sum of SIXTY SEVEN THOUSAND <br />TWO HUNDRED FORTY ONE DOLLARS AND THIRTY-SEVEN CENTS ($67,241.37) <br />therefore, the property hereinabove described. <br />NOW THEREFORE, in consideration of such payment and in <br />accordance with the request of the beneficiary, the undersigned, <br />as Trustee by these presents does hereby grant, remise, release <br />and convey to Monument Street Funding II, LLC, its successors and <br />assigns, all the interest and estate derived to said Trustee by <br />or through said Trust Deed in the above-described premises <br />together with all buildings, fixtures, improvements and <br />appurtenances belonging to said premises. <br />DATED this 12th day of January, 2006. <br /> <br />~~.~~ <br /> <br />Successor Trustee <br />
