<br />COMES NOW the undersigned, Chris A. Engel, and after being first duly sworn upon oath, would
<br />hereby depose and state as follows:
<br />1. My name is Chris A. Engel. I am 49 years old, and I have resided in Hall County, Nebraska
<br />my entire life. I grew up on a farm in the Doniphan, Hall County, Nebraska area, and I currently own real
<br />estate in that vicinity.
<br />2. During my entire life, I was well familiar with John Meier, also known as John William
<br />Meier, and his sons, Wilber L. Meier and Marlin B. Meier.
<br />3. From my own personal knowledge, I am aware that John W. Meier, alk/a John William
<br />Meier, died January 24, 1997. His son, Wilber L. Meier, died on August 26, 1999. Wilber Meier's wife,
<br />Frances Meier, died on November 2,2002.
<br />4. By warranty deed filed as Document No. 96-100594 in the office of the Register of Deeds
<br />of Hall County, Nebraska, dated January 26, 1996, Marlin B. Meier, Wilber L. Meier, and John W. Meier
<br />conveyed certain real estate to me. Their marital status was not disclosed. From my own personal
<br />knowledge, Marlin B. Meier is still alive and his wife, Nancy Meier, is still living. Both Wilber L. Meier
<br />and his spouse, Frances Meier, are deceased. John W. Meier was not married on the date he signed the deed.
<br />5. From my own personal knowledge, Marlin B. Meier and his wife, Nancy Meier, reside in
<br />the State of California. Wilber L. Meier and his spouse, Frances Meier, lived in El Paso County, Colorado,
<br />and then relocated to Apache Junction, Arizona, which was their domicile at the time oftheir deaths. John
<br />W. Meier lived in EI Paso County, Colorado. The real estate conveyed to me by warranty deed, appearing
<br />as Document No. 96-100594, was non-homestead property. None of the Grantors in this deed, or their
<br />spouses, resided on the real estate, and it was never their homestead.
