CD <br />G "" :x: ~ Cl r <br />G I rn -'0 <br />(.Tl r) ~ ::::3 <br />....l. r, Cl <br />N en <br />Q) Ci) <br />c.o <br />+::. ....r:. <br /> c...> <br /> <br />ADDENDUM TO DECLARATION OF RESTRICTIVE COVENANTS <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />(") C,I) ~;\"ftl;i; ~~ <br />o -i <br />c:::t> <br />Z-i O~ <br />-irn <br />-<0 <br />0"'" ~Gi' <br />""'z <br />::r: m ~I <br />1'> OJ <br />,Xl <br />,:Po <br /><.n <br />^ <br />)> <br />-- <br />C,I) <br />C,I) 2 <br /> 0 <br /> <br />G <br />/3,IJIJ <br /> <br />WHEREAS, Arlington Investments, Inc., a Nebraska corporation <br />("Arlington") is the owner of the real property described as Lots <br />1, 2, 3, 4, and 5 in Richmond Fourth Subdivision in the City of <br />Grand Island, Hall County, Nebraska; and <br /> <br />WHEREAS, Manmohan Patel and Shaila Patel, husband and wife, <br />("Patel") are the owners of the property legally described as Lot <br />6, Richmond Fourth Subdivision in the City of Grand Island, Hall <br />County, Nebraska; and <br /> <br />WHEREAS, Arlington entered into a Declaration of Restrictive <br />Covenants which were filed with the Register of Deeds of Hall <br />County, Nebraska, on June 30, 2004, as Document No. 0200406501 <br />("the Covenants"); and <br /> <br />WHEREAS, Paragraph 8 of the Covenants sets forth the terms and <br />conditions for modification of the Covenants by owners of 3/5ths of <br />the lots of Richmond Fourth subdivision; and <br /> <br />WHEREAS, Arlington and Patel own all lots of Richmond Fourth <br />Subdivision and desire to amend the terms and conditions of the <br />Covenants. <br /> <br />NOW, THEREFORE, IT IS AGREED and determined by Arlington and <br />Patel as follows: <br /> <br />1. Except as set forth herein, the Covenants shall remain in <br />full force and effect. <br /> <br />2. Paragraph 4 (e) of the Covenants is hereby deleted and the <br />following is substituted as the new terms and conditions of <br />Paragraph 4 (e) : <br /> <br />(e) All buildings shall be one story in height, except a <br />motel or hotel maybe constructed on Lot 5 or Lot 6 with <br />a maximum of three stories. <br /> <br />3. This Addendum to the Covenants shall be effective from <br />the date of filing with the Register of Deeds of Hall County, <br />
