<br />KNOW ALL MEN BY THESE PRESENTS:
<br />
<br />THAT WHEREAS, in an action found at Case No. CI 05-125 in the District
<br />Court of Hall County, Nebraska, wherein Centex Home Equity Company, LLC, a
<br />limited liability company, is the plaintiff, and Bonnie Kluthe, Michael F. Kivett,
<br />Trustee, andCitiFinancial, Inc., Beneficiary, are the defendants, Centex Home
<br />Equity Company, LLC, a Delaware limited liability company, did obtain a Decree
<br />finding that there is due the plaintiff the sum of Sixty-Nine Thousand Five
<br />Hundred Thirty-Three Dollars and Ten Cents ($69,533.10), plus interest, escrow
<br />advances, title search costs and costs of suit; and
<br />
<br />WHEREAS, it was further ordered in said Decree that in default of the
<br />payment of the sum so found due by the defendants, that the appointed Master
<br />Commissioner should cause the lands and tenements hereinafter described to be
<br />advertised a,nd sold according to law to pay the same; and
<br />
<br />WHEREAS, default in payment having been made therein, Arend R. Baack,
<br />Master Coml;Tlissioner under and by virtue of th~s9id Decree and the Or~ero! Sale
<br />to him duly'pirected, did on October 18.2005, inside the front door of the Hall
<br />County Courthouse, in the City of Grand Island, Hall County, Nebraska, having first
<br />given due ari~ legal notice of the time and place of said sale by publication once in
<br />each week for four consecutive weeks in a newspaper printed and in general
<br />circulation in said County of Hall, sell said premises at public auction to Centex
<br />Home Equity, Company, LLC, a Delaware limited liability company, formerly known
<br />as Centex Credit Corporation, d/b/a Centex Home Equity Corporation, for the sum
<br />of Seventy-Eight Thousand Dollars ($78,000.00); and
<br />
<br />WHEREAS such Master Commissioner's sale was afterward confirmed on
<br />November 8; 2005, and the said Arend R. Baack as Master Commissioner was
<br />ordered to ~onvey said premises in fee simple title to Centex Home Equity
<br />Company, L~C, a Delaware limited liability company, formerly known as Centex
