<br />200512063 <br /> <br />ARTICLE VII <br /> <br />COVENANT FOR INSURANCE <br /> <br />The Association shall maintain hazard and casualty insurance <br />and Association liability insurance for residential structures on <br />each Lot. Said insurance will not provide coverage to Owner for <br />Owner's contents or personal liability. The Owner of each Lot is <br />hereby deemed to covenant and agree to pay any deductible amounts <br />for Owner's contents or personal liability. The Owner of each Lot <br />is hereby deemed to covenant and agree to pay any deductible <br />amounts for repairs to structures as may be provided in said <br />insurance policies maintained by the Association. Association <br />insurance coverage shall be for the replacement costs of the <br />residential dwelling structure on each Lot. <br /> <br />ARTICLE VIII <br /> <br />GENERAL PROVISIONS <br /> <br />Section 1. Enforcement. The Association, or any Owner, <br />shall have the right to enforce by any proceeding at law or in <br />equity, all restrictions, conditions, covenants, reservations, <br />easements, liens and charges now or hereafter imposed by the <br />provisions of this Declaration, either to prevent or restrain any <br />violation of same, or to recover damages or other dues for such <br />violation. Failure by the Association or by any Owner to enforce <br />any covenant or restriction herein contained shall in no event be <br />deemed a waiver of the right to do so thereafter. <br /> <br />Section 2. Severability. Invalidation of anyone of these <br />covenants or restrictions by judgment or court order shall in no <br />way affect any other provisions which shall remain in full force <br />and effect. <br /> <br />Section 3. Amendment. The covenants and restrictions of <br />this Declaration shall run with and bind the land, for a term of <br />Forty (40) years from the date this Declaration is recorded, after <br />which time they shall be automatically extended for a successive <br />period of Ten (10) years. The Declaration may be amended by an <br />instrument signed by the Owners of not less than Sixty-Six and <br />Two~Thirds Percent (66-2/3%) of the Lots. Any amendment must be <br />recorded. <br /> <br />EXECUTED the day and year first above written. <br /> <br />-9- <br />
