<br />That a Deed of Trust was made and entered into on or about April 27, 2001, by and between
<br />Adam L. Marine, a single person, as Trustor, and Major Mortgage, a Wyoming Corporation,
<br />Beneficiary, wherein Commercial Federal Bank, a Federal Savings Bank, was named Trustee. This
<br />Deed of Trust was recorded April 30, 2001 in the Records of the Register of Deeds of Hall County,
<br />Nebraska as Instrument No. 2001-03795.
<br />
<br />On or about April 27, 2001, Major Mortgage, a Wyoming Corporation, Beneficiary, assigned all
<br />of its right, title and beneficial interest in the Deed of Trust to Commercial Federal Mortgage
<br />Corporation. The Assignment was recorded July 12, 2001, in the office of the Register of Deeds of Hall
<br />County, Nebraska, as Instrument No. 2001-06842.
<br />
<br />On or about July 1, 2005, Commercial Federal Bank, a Federal Savings Bank, successor to
<br />Commercial Federal Mortgage Corporation, Beneficiary, assigned all of its right, title and beneficial
<br />interest in the Deed of Trust to Wells Fargo Bank, N.A. The Assignment was recorded in the office of
<br />the Register of Deeds of Hall County, Nebraska.
<br />
<br />Hereinafter the Trustee, Commercial Federal Bank, a Federal Savings Bank, will be referred to
<br />as GRANTOR.
<br />
<br />The GRANTOR in consideration of Forty-Five Thousand Nine Hundred Sixty-Two Dollars
<br />and Nineteen Cents ($45,962.19) and other valuable consideration received from Wells Fargo Bank,
<br />N.A., hereinafter GRANTEE, does hereby grant, bargain, sell, convey and confirm unto GRANTEE th~
<br />following described real property in Hall County, Nebraska:
<br />
<br />A tract of land comprising the Southerly Eighty-Nine (89) feet of the Northerly One
<br />Hundred Nine (109) feet of the Easterly Sixty-Four (64) feet of Lot Nine (9) of the
<br />County Subdivision in the South Half (S 1/2) of the Southeast Quarter (SE1/4) of
<br />Section Sixteen (16), Township Eleven (11) North, Range Nine (9) West of the 6th
<br />P.M., in Hall County, Nebraska
<br />
<br />To have and to hold the above-described premises together with all tenements, hereditaments and
<br />appurtenances thereto belonging unto the GRANTEE, and to the GRANTEE'S successors and assigns
<br />forever.
<br />
<br />GRANTOR does hereby covenant with the GRANTEE and with the GRANTEE'S successors
<br />and assigns:
<br />
<br />(1) That Adam L. Marine, a single person, as Trustor, failed to pay the Beneficiary payments
<br />which were contractually due, and the GRANTOR, at the request of the Beneficiary, elected to declare
<br />the entire unpaid principal balance, together with interest thereon, at once immediately due and payable.
<br />
<br />(2) That a Notice of Default was recorded by GRANTOR on May 31, 2005, as Instrument
<br />No. 2005-04845, in the records ofthe Register of Deeds, Hall County, Nebraska. Within ten (10) days
<br />thereafter, a copy of the recorded Notice of Default was mailed by certified mail, postage prepaid, to all
<br />parties entitled to notice, pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. ~ 76-
<br />1008 (Reissue 2003).
<br />
<br />(3) That Trustor, Adam L. Marine, a single person, failed to cure the default referenced in the
<br />Notice of Default within 30 days after the recording ofthe Notice of Default.
