<br />TRUSTEE'S DEED
<br />
<br />KNOW ALL MEN BY THESE PRESENTS:
<br />
<br />THA T Michael F. Kivett, Attorney at Law duly licensed to practice in the State of Nebraska,
<br />Trustee, in the exercise of the power of sale conferred upon him, does hereby execute and deliver this
<br />indenture,
<br />
<br />WITNESSETH THA T:
<br />
<br />WHEREAS, for a valuable consideration on August 26, 2002, Odell Donahoo and Mary Kay
<br />Shay a/k/a Mary Kay Donahoo, as joint tenants, Trustors, executed and delivered their Deed of Trust to
<br />Michael F. Kivett, as Trustee, and CitiFinancial, Inc. (MD), as Beneficiary, conveying the real estate
<br />hereinafter described in trust, with power of sale, in accordance with the terms and provisions set forth
<br />therein; that said Deed of Trust was thereafter recorded on August 28, 2002 in the office of the Register
<br />of Deeds of Hall County, Nebraska as Instrument No. 200209061; and
<br />
<br />WHEREAS, the Trustors having defaulted in the payment of the indebtedness secured thereby
<br />and the Beneficiary having delivered to the Trustee a written declaration of default and having deposited
<br />with the Trustee all promissory notes together with Notice of Default; and
<br />
<br />WHEREAS, in compliance with Sec. 76-1006, Statutes of Nebraska, on September 9,2005, the
<br />Trustee filed a Notice of Default in the office of the Register of Deeds of Hall County, Nebraska, as
<br />Instrument No. 0200508896, which Notice fully complied with the requirements of said statute; and
<br />
<br />WHEREAS, in compliance with Sec. 76-1008, Statutes of Nebraska, on September 16, 2005, the
<br />Trustee mailed by certified mail, with postage prepaid, a copy of such Notice of Default with the
<br />recording date shown thereon, addressed to the following interested parties, to-wit:
