<br />any ether party the right ta remave, any timber, minerals (including .oil and gas), caal, clay, sceria, seil, gravel .or reck preducts
<br />withaut Lender's priar written censent.

<br />Remaval .of Impravements. Trustar shall nat demalish .or remeve any Imprevements fram the Real Property withaut Lender's priar
<br />written censent. As. a canditian ta the remeval .of any Improvements, Lender may require Trustar ta make arrangements satisfactery
<br />ta Lender ta replace such Imprevements with Impravements .of at least equal value.
<br />
<br />Lender's Right ta Enter. Lender and Lender's agents and representatives may enter upan the Real Praperty at all reasenable times te
<br />attend ta Lender's interests and teinspect the Real Praperty far purpases .of Trustar's campliance with the terms and canditians .of
<br />this Deed .of Trust.
<br />
<br />Campllance with Gavernmental Requirements. Trustar shall premptly cemply with all laws, .ordinances, and regulatians, naw .or
<br />hereafter in effect, .of all gevernmental autharities applicable te the use .or .occupancy .of the Praperty. Trustar may cantest in gaad
<br />faith any such law, .ordinance, .or regulatien and withheld campliance during any proceeding, including apprepriate appeals, se leng as
<br />Trustor has notified Lender in writing prier to deing so and sa lang as, in Lender's sale apinian, Lender's interests in the Property are
<br />nat jeapardized. Lender may require Trustar ta past adequate security .or a surety bend, reasenably satisfactary ta Lender, ta pratect
<br />Lender'. interest.
<br />
<br />Duty ta Pratect. Trustar agrees neither ta abanden .or leave unattended the Property. Trustar shall da all ather acts, in additien te
<br />thase acts set farth abave in this sectien, which fram the character and use .of the Praperty are reasenably necessary ta pretect and
<br />preserve the Preperty.
<br />
<br />TAXES AND LIENS. The fallawing previsiens relating ta the taxes and liens an the Property are part .of this Deed .of Trust:

<br />Payment. Trustar shall pay when due (and in all events priar te delinquency) all taxes, special taxes, assessments, charges (including
<br />water and sewer), fines and impasitians levied against .or an accaunt of the Property, and shall pay when due all claims far wark dane
<br />an .or far services rendered .or material furnished to the Property. Trustar shall maintain the Praperty free .of all liens having prierity
<br />ever .or equal ta the interest of Lender under this Deed .of Trust, except fer the lien .of taxes and assessments not due, except for the
<br />Existing Indebtedness referred ta belaw, and except as .otherwise previded in this Deed .of Trust.
<br />
<br />Right ta Cantest. Trustar may withheld payment .of any tax, assessment, .or claim in cannectian with a gaad faith dispute aver the
<br />abligatian ta pay, sa lang as Lender's interest in the Property is nat jeapardized. If a lien arises .or is filed as a result .of nanpayment,
<br />Truster shall within fifteen (15) days after the lien arises .or, if a lien is filed, within fifteen (15) days after Trustar has netice .of the
<br />filing, secure the discharge of the lien, .or if requested by Lender, de pas it with Lender cash .or a sufficient cerperate surety bend .or
<br />ather security satisfactary ta Lender in an ameunt sufficient te discharge the lien plus any cests and reasanable attarneys' fees, .or
<br />ather charges that cauld accrue as a result .of a fereclesure .or sale under the lien. In any cantest, Trustar shall defend itself and
<br />Lender and shall satisfy any adverse judgment before enforcement against the Property. Trustar shall name Lender as an additianal
<br />.obligee under any surety band furnished in the cantest praceedings.
<br />
<br />Evidence .of Payment. Truster shall upen demand furnish to Lender satisfactary evidence .of payment .of the taxes .or assessments and
<br />shall autherize the apprapriate gavernmental .official ta deliver ta Lender at any time a written statement .of the taxes and assessments
<br />against the Praperty.
<br />
<br />Natice .of Canstructlan. Truster shall netify Lender at least fifteen (15) days befare any wark is cammenced, any services are
<br />furnished, .or any materials are supplied to the Property, if any mechanic's lien, materialmen's lien, .or ather lien cauld be asserted an
<br />accaunt .of the wark, services, .or materials and the cest exceeds $10,000.00. Truster will upen request .of Lender furnish te Lender
<br />advance assurances satisfactary ta Lender that Truster can and will pay the cest .of such imprevements.
<br />
<br />PROPERTY DAMAGE INSURANCEr .:The- following provisians relating tQ. ins.uringthe. Praperty are a part .of this Deed .of Trust.
<br />
<br />Maintenance .of Insurance. Truster shall precure and maintain pelicies .of fire insurance with standard extended caverage
<br />endersements an a replacement basis far the full insurable value covering all Impravements an the Real Praperty in an amaunt
<br />sufficient te aveid applicatien .of any ceinsurance clause, and with a standard mortgagee clause in faver .of Lender, tegether with such
<br />ather hazard and liability insurance as Lender may reasanably require. Palicies shall be written in farm, amaunts, caverages and basis
<br />reasanably acceptable ta Lender and issued by a campany .or campanies reasanably acceptable ta Lender. Trustar, upen request .of
<br />Lender, will deliver te Lender frem time te time the pelicies .or certificates .of insurance in ferm satisfactery ta Lender, including
<br />stipulatians that caverages will nat be cancelled .or diminished withaut at least thirty (30) days priar written netice te Lender. Each
<br />insurance palicy alsa shall include an endarsement praviding that caverage in favar .of Lender will not be impaired in any way by any
<br />act, emissien .or default .of Truster .or any ether persen. Sheuld the Real Preperty be lecated in an area designated by the Directar .of
<br />the Federal Emergency Management Agency as a special f1eed hazard area, Truster agrees ta .obtain and maintain Federal Flaad
<br />Insurance, if available, within 45 days after natice is given by Lender that the Praperty is lecated in a special fleed hazard area, far the
<br />maximum amaunt .of yaur credit line and the full unpaid principal balance .of any priar liens an the praperty securing the lean, up ta the
<br />maximum pelicy limits set under the Natienal Fleed Insurance Pregram, .or as .otherwise required by Lender, and to maintain such
<br />insurance fer the term .of the laan.
<br />
<br />Applicatian .of Praceeds. Truster shall premptly netify Lender .of any lass .or damage ta the Praperty if the estimated cest .of repair .or
<br />replacement exceeds $10,000.00. Lender may make praef .of lass if Trustar fails ta da sa within fifteen (15) days .of the casualty.
<br />Whether or net Lender's security is impaired, Lender may, at Lender's electien, receive and retain the proceeds .of any insurance and
<br />apply the praceeds ta the reductian .of the Indebtedness, payment .of any lien affecting the Preperty, .or the restaratian and repair .of
<br />the Praperty. If Lender elects ta apply the praceeds ta restaratian and repair, Trustor shall repair .or replace the damaged .or destrayed
<br />Impravements in a manner satisfactery te Lender. Lender shall, upen satisfactary praaf .of such expenditure, pay .or reimburse Truster
<br />fram the praceeds far the reasenable cost of repair .or resteratien if Truster is n.ot in default under this Deed .of Trust. Any preceeds
<br />which have net been disbursed within 180 days after their receipt and which Lender has nat cemmitted te the repair .or restaratian .of
<br />the Praperty shall be used first te pay any ameunt .owing t.o Lender under this Deed .of Trust, then te pay accrued interest, and the
<br />remainder, if any, shall be applied ta the principal balance .of the Indebtedness. If Lender h.olds any praceeds after payment in full .of
<br />the Indebtedness, such proceeds shall be paid te Truster as Truster's interests may appear.
<br />

<br />claims, (B) ta previde any required insurance en the Pr.operty, .or (e) ta make repairs ta the Preperty then Lender may da sa. If any
<br />actian .or praceeding is cemmenced that weuld materially affect Lender's interests in the Praperty, then Lender en Truster's behalf may,
<br />but is net required t.o, take any actian that Lender believes ta be apprepriate te pretect Lender's interests. All expenses incurred .or paid by
<br />Lender fer such purpeses will then bear interest at the rate charged under the Credit Agreement frem the date incurred .or paid by Lender ta
<br />the date .of repayment by Trustor. All such expenses will beceme a part .of the Indebtedness and, at Lender's eptien, will (A) be payable
<br />en demand; (8) be added ta the balance .of the Credit Agreement and be appertiened amang and be payable with any installment
<br />payments te beceme due during either (1) the term .of any applicable insurance pelicy; .or (2) the remaining term of the Credit
<br />Agreement; .or (C) be treated as a balloen payment which will be due and payable at the Credit Agreement's maturity. The Praperty alsa
<br />will secure payment .of these amounts. The rights previded fer in this paragraph shall be in addition to any ether rights .or any remedies ta
<br />which Lender may be entitled en acc.ount .of any default. Any such actian by Lender shall n.ot be c.onstrued as curing the default se as ta
<br />bar Lender fram any remedy that it .otherwise wauld have had.
<br />
<br />WARRANTY; DEFENSE OF TITLE. The fallawing pravisians relating ta .ownership .of the Preperty are a part .of this Deed .of Trust:

<br />Title. Truster warrants that: (a) Trustar halds good and marketable title .of record t.o the Praperty in fee simple, free and clear .of all
<br />liens and encumbrances ether than these set farth in the Real Property descriptien .or in any title insurance palicy, title repert, .or final
<br />title .opinion issued in faver .of, and accepted by, Lender in cannectian with this Deed .of Trust, and (b) Trustar has the full right,
<br />pewer, and autharity ta execute and deliver this Deed .of Trust te Lender.
