<br />KNOW ALL MEN BY THESE PRESENTS, THAT WHEREAS, Brent S. Rainforth and Suzanne Rainforth, husband
<br />& wife hereinafter referred to as "Trustors" did on the 3rd day of November, 2004 execute and deliver to James E.
<br />Stulken, Trustee for the James E. Stulken Revocable Trust and Margaret J. Stulken, Trustee for the Margaret J. Stulken
<br />Revocable Trust, A Deed of Trust upon certain real estate located in Hall County, Nebraska and legally described as:
<br />Lot One (1), Stulken Subdivision, Hall County, Nebraska, subject to the following: A Thirty Foot (30') ingress and
<br />egress easement shall be retained along the South Line of Lot One (1) to the South Half (S 1/2) of Section Seven (7),
<br />Township Nine (9) West, Range Ten (10), Hall County Nebraska
<br />
<br />Conditioned for and secure to the payment of the sum shown on the NOTE, which Deed of Trust was recorded in the
<br />Office of the Register of Deeds of Hall County on the 24th day of February 2005 as Instrument No. 0200501538.

<br />WHEREAS, Trustors, for the purpose, among other things, of paying or securing certain debts, have agreed to
<br />execute and deliver a Deed of Trust upon the real estate to Washington Mutual Bank conditioned for the payment of the
<br />sum of One hundred fifty nine thousand two hundred no/l00 to be a First Deed of Trust upon the premises, recorded in :\
<br />the Register of Deeds Office Hall County Nebraska on the 16th day or May 2005 Instrument No..0229S0616B. A: r

<br />NOW, THEREFORE, James E Stulken, Trustee for the James E. Stulken Revocable Trust, and Margaret J. .

<br />receipt and adequacy of which is hereby acknowledged, does hereby bargain, consent, promise and agree to and with
<br />Trustors, their heirs and assigns, that the Deed of Trust upon the premises thus to be executed by Trustors to James E.
<br />Stulken, Trustee for the James E. Stulken Revocable Trust and Margaret 1. Stulken, Trustee for the Margaret 1. Stulken
<br />Revocable Trust for the amount and interest above mentioned, shall at all times be a prior Deed of Trust and a prior lien
<br />upon the premises to the Deed of Trust as above described.
