BOX 2280, <br />GRAND ISLAND NE 68802 <br /> <br />You are hereby given Notice of Default under a Deed of Trust <br />executed by Lisa Ann Filbin, a single person, and John M. <br />Cunningham, a married person, dated April 19, 2005, and recorded <br />April 27, 2005, as Document No. 0200503750 in the Office of the <br />Register of Deeds of Hall County, Nebraska; said Deed of Trust <br />securing the following property: <br /> <br />LOT TEN (10), IN BLOCK THREE (3), IN THE FIRST ADDITION <br />TO THE VILLAGE, NOW CITY OF WOOD RIVER, HALL COUNTY, <br />NEBRASKA, known as 208 E. 12th, Wood River, Nebraska <br /> <br />said Deed of Trust being in favor of Five Points Bank, a Nebraska <br />Banking Corporation, Trustee and Beneficiary under said Deed of <br />Trust. <br /> <br />Said default under the terms of said Deed of Trust has <br />occurred by virtue of nonpayment of the payments as they became <br />due and payable under a Promissory Note dated April 19, 2005, and <br />designated as Loan No. 101205877, in the principal sum of FORTY <br />TWO THOUSAND SIX HUNDRED FORTY-THREE DOLLARS and SEVENTY-NINE <br />CENTS ($42,643.79), with a total principal balance due and owing <br />as of November 17, 2005, of FORTY TWO THOUSAND SIX HUNDRED FORTY- <br />THREE DOLLARS and SEVENTY-NINE CENTS ($42,643.79), unpaid interest <br />of ONE THOUSAND FIVE HUNDRED FIFTY-SIX DOLLARS and SEVENTY-NINE <br />CENTS ($1,556.79) for a total payoff of FORTY FOUR THOUSAND TWO <br />HUNDRED DOLLARS and FIFTY-EIGHT CENTS ($44,200.58. <br /> <br />In addition, Trustors are hereby liable to Trustee, Five <br />Points Bank, for all fees and costs associated with this default <br />and recovery pursuant to Nebraska Statute 976-1012. <br /> <br />By virtue of said default, Trustee, Five Points Bank, has <br />determined to sell or cause to be sold the trust property to <br />satisfy the obligations referred to above. <br /> <br />The default may be cured within Thirty (30) days of the <br />filing of this Notice, and the obligations of the Deed of Trust <br />may be thereby reinstated as provided in Nebraska Statute 976- <br />1012. <br /> <br />DATED: November 17, 2005. <br />
