Each undersigned Borrower has agreed to act as Trustor in the DEED OF TRUST to <br />which this writing is the Preface and wherein ALICE L. EADES, TRUSTEE, is the Beneficiary <br />and which is hereinafter referred to as the Trust Deed. <br /> <br />~ <br />,J' <br />'" 'c' <br /> <br />2. Each undersigned Borrower knows that by virtue of the statutes of the State of <br />Nebraska each Borrower has the right to make a Designation of Homestead in the body ofthe <br />Trust Deed. <br /> <br />3. EACH UNDERSIGNED BORROWER DOES HEREBY DISCLAIM THE <br />RIGHT TO MAKE A DESIGNATION OF HOMESTEAD IN THE BODY OF THE TRUST <br />DEED. <br /> <br />4. Each undersigned Borrower does hereby state that no part of Borrower's <br />homestead is presently or in the future will be situated upon the real estate described in the Trust <br />Deed. Each undersigned Borrower understands this to mean that whether or not each <br />undersigned Borrower is presently residing upon the real estate described in the Trust Deed and <br />whether or not each undersigned Borrower hereafter establishes residence and a homestead upon <br />any part of that real estate during the time that the Trust Deed remains unsatisfied and a lien upon <br />the real estate, EACH UNDERSIGNED BORROWER SHALL HA VE NO RIGHT TO MAKE <br />A DESIGNATION OF HOMESTEAD in the event of Trustee's sale under the power of sale <br />contained in the Trust Deed. <br /> <br />5. EACH UNDERSIGNED BORROWER DOES HEREBY WAIVE BY THIS <br />WRITTEN ACKNOWLEDGMENT ANY AND ALL RIGHT TO MAKE A DESIGNA nON <br />OF HOMESTEAD UPON ANY PART OF THE REAL ESTATE DESCRIBED IN THE <br />TRUST DEED. Each undersigned Borrower understands that the execution of this <br />acknowledgment constitutes the waiver of rights otherwise available for the purpose of affording <br />Borrower the opportunity to retain Borrower's homestead in the event of a default upon the Trust <br />Deed. <br /> <br />6. Each undersigned Borrower represents that this Preface to Deed of Trust <br />constitutes a disclaimer of right to make a Designation of Homestead and a waiver of right to <br />make a declaration of homestead as provided for in paragraphs 3(a) and 3(b) of Section 4 of the <br />Nebraska Farm Homestead Protection Act.
