200510850 <br />(d) Senior debt obligations issued by the following agencies <br />which are backed by the full faith and credit of the U.S.: (i) U.S. Export- <br />Import Bank (Eximbank)(direct obligations or fully guaranteed certificates <br />of beneficial ownership); (ii) Farmers Home Administration <br />(FmHA)(certificates of beneficial ownership); (iii) Federal. Financing Bank; <br />(iv) General Services Administration (participation certificates); (v) U.S. <br />Maritime Administration (guaranteed Title XI financing); or (vi) U.S. <br />Department of Housing and Urban Development (HUD)(Project Notes, <br />Local Authority Bonds, New Communities Debentures - -U.S. government <br />guaranteed debentures, U.S Public Housing Notes and Bonds - -U.S. <br />government guaranteed public housing notes and bonds). <br />"Indenture" - this Trust Indenture and Security Agreement together with all <br />supplements hereto. <br />"Insurer" - Ambac Assurance Corporation, a Wisconsin - domiciled stock <br />insurance company, the issuer of the "Policy" as defined below. <br />"Library Board Easement" — the License and Agreement to be executed and <br />delivered by the City's library board in accordance with the terms of Section IX of <br />the Addendum to Lease Purchase Agreement which constitutes a part of the <br />Agreement. <br />"outstanding hereunder" or "bonds outstanding hereunder" - all bonds <br />which have been authenticated, issued and delivered under this indenture except: <br />(a) bonds cancelled because of payment; <br />(b) bonds for the payment of which cash or Government <br />Obligations shall have been theretofore deposited with the <br />Trustee, whether upon or prior to the maturity date of any of <br />said bonds; and <br />(c) bonds in lieu of which other bonds have been authenticated as <br />provided under Article II hereof. <br />"Person" - includes natural persons, firms, associations, corporations and <br />public bodies. <br />"Payments" - the payments for the purchase and leasing of the Project as <br />described and defined in the Agreement. <br />"Policy" - the Financial Guaranty Insurance Policy issued by the Insurer <br />insuring the payment when due of the principal of and interest on the Building <br />Bonds as provided therein. <br />5 <br />
