Each of the undersigned has agreed to act as <br />Mortgagor in the MORTGAGE to which this writing is the Preface <br />and wherein JUDITH ANN HAPPOLD is the Mortgagee and who is <br />hereinafter referred to as the Mortgage. <br />2. Each of the undersigned knows that by virtue of <br />the statutes of the State of Nebraska each of us has the right to <br />make a Designation of Homestead in the body of the Mortgage. <br />3. EACH OF THE UNDERSIGNED DOES HEREBY DISCLAIM THE <br />RIGHT TO MAKE A DESIGNATION OF HOMESTEAD IN THE BODY OF THE <br />MORTGAGE. <br />4. Each of the undersigned does hereby state that no <br />part of our homestead is presently or in the future will be <br />situated upon the real estate described in the Mortgage. Each of <br />the undersigned understands this to mean that whether or not the <br />undersigned is presently residing upon the real estate described <br />in the Mortgage and whether or not each of the undersigned <br />hereafter establishes residence and a homestead upon any part of <br />that real estate during the time that the Mortgage remains <br />unsatisfied and a lien upon the real estate, EACH OF THE <br />UNDERSIGNED SHALL HAVE NO RIGHT TO MAKE A DESIGNATION OF <br />HOMESTEAD in the event of foreclosure sale under the provisions <br />of the Mortgage. <br />5. EACH OF THE UNDERSIGNED DOES HEREBY WAIVE BY THIS <br />WRITTEN ACKNOWLEDGMENT ANY AND ALL RIGHT TO MAKE A DESIGNATION OF <br />HOMESTEAD UPON ANY PART OF THE REAL ESTATE DESCRIBED IN THE <br />MORTGAGE.
