<br />AND STEPHEN H. HAPPOLD, wife and husband, each in her and his own
<br />right and as spouse of the other, herein called the Grantors, for
<br />and in consideration of the sum of ONE DOLLAR ($1.00) received
<br />from Grantee, do hereby grant, bargain, sell, convey and confirm
<br />unto RYAN HAPPOLD, the following described real estate situated
<br />in Hall County, Nebraska:

<br />(8), Township Nine (9) North, Range Nine (9), West of the
<br />6th P.M., Hall County, Nebraska, which lies East of the East
<br />line of the former Right of Way of the Hastings & Grand
<br />Island R. R. Co. (also known as the St. Joseph & Grand
<br />Island R. R. Co.), except a tract of 7 1 /10 acres described
<br />as follows: Beginning at a point of intersection of the East
<br />line of said Right of Way with the North line of said
<br />Section Eight (8), running thence South along said East line
<br />321� rods; thence East 35 rods; thence North to the North
<br />line of said Section 321,� rods and thence West 35 rods to the
<br />place of beginning; the tract hereby conveyed containing 67
<br />acres, be the same a little more or less,

<br />an undivided one -half ('�) interest in all of a strip of land
<br />of varied width, upon and thru the West Half of the
<br />Northeast Quarter (W'�NE'-4) of Section Eight (8), Township
<br />Nine (9) North, Range Nine (9), West of the 6th P.M., Hall
<br />County, Nebraska, beginning at the South corporate limits of
<br />Doniphan, NE, and proceeding South to the half mile line of
<br />Section Eight (8), containing 4.13 acres, more or less.
<br />TO HAVE AND TO HOLD the premises above described, together
<br />with all the tenements, hereditaments and appurtenances thereunto
<br />belonging, unto the said Grantee and to Grantee's heirs and
<br />assigns forever. And we hereby covenant with the said Grantee
<br />and with Grantee's heirs and assigns, that we are lawfully seized
<br />of said premises, that they are free from encumbrance, except
<br />easements and restrictions of record, and that we have good right
