<br />Recitation of Facts:
<br />1. On March 1, 1986, Carl R. Amick and Renee J. Amick, hereafter referred to as the
<br />" Amick's," executed a First Right of Refusal between themselves and Dr. Gregg Peterson,
<br />D.D.S. concerning certain real estate property owned by the Amick's and located in
<br />Section Two (2), Township Nine (9) North, Range Ten (10) West of the 6:00 p.m. in Hall
<br />County, Nebraska. The full legal description of the affected property is attached hereto as
<br />Addendum #1. The First Right of Refusal was filed with the Hall County Register of
<br />Deeds on March 12, 1986, and recorded as Document No. 86- 101182.
<br />2. On November 21, 1997, the Amick's filed with the Hall County Register of Deeds
<br />a final plat for the Amick Acres West Subdivision, Document No. 97- 109890. The Amick
<br />Acres West Subdivision includes seventy -one residential (7 1) lots.
<br />3. The Amick's and Dr. Peterson hereby acknowledge that all of the following real
<br />estate lots, or portions of such lots, specifically Lots / 58, 59, 60, .
<br />65, 66, 67, 68, 69, and 70 of the Amick Acres West Subdivision are located in the above
<br />described real estate property.
<br />Based on the above recitation of facts, Dr. Gregg Peterson, D.D.S. the holder
<br />of a First Right of Refusal affecting the above described real estate hereby agrees to
<br />the following:
<br />tect Dr. Gregg Peterson, D.D.S., grants a release of the First Right of Refusal as it may
<br />Lots 58, 59, 60, 65, 66, 67, 68, and 69 of the Amick
<br />Acres West Subdivision.
<br />2. The partial release shall not affect Lot 70 of the Amick Acres West Subdivision;
<br />and the original First Right of Refusal shall remain in effect for all remaining real estate
<br />property owned by the Amick's that was included in the above described property and
<br />more fully described in the attached Addendum.
