M <br />_C' <br />C> c, m <br />; <br />' o <br />° __4 m <br />C € n m N Q. <br />� W n U <br />N p 'Tt O <br />\ { r CJ <br />r <br />O m <br />° CT) <br />` r n C', ca � w <br />cn cn <br />o) C0 Z <br />f O <br />DEED OF TRUST MODIFICATION AGREEMENT <br />(Future Advance Provision and Extension Agreement) <br />THIS MORTGAGE /DEED OF TRUST MODIFICATION AGREEMENT made and <br />executed this 22nd of DECEMBER, 2003, by and between VisionComm Vending, Inc., <br />hereinafter referred to as "Borrower ", and HOME FEDERAL SAVINGS AND LOAN ° <br />G <br />ASSOCIATION OF GRAND ISLAND, hereinafter referred to as "lender ", <br />WITNESSETH: <br />WHEREAS, Borrower did execute a certain Deed of Trust dated July 25, 2003, filed of <br />record in the OFFICE OF THE HALL COUNTY REGISTER OF DEEDS on July 28, 2003 as <br />INSTRUMENT NO. 0200309665 in respect to that real estate described as: <br />Lots Thirty (30) and Thirty -One (31), Bosselman Second Subdivision, an <br />Addition to the City of Grand Island, Hall County, Nebraska <br />Lots One (1), Two (2), Three (3), and Four (4), Woodland Fourth Subdivision in <br />the City of Grand Island, Hall County, Nebraska <br />WHEREAS, such Deed of Trust does not contain a provision regarding a right to future <br />advances to be secured by such Deed of Trust; <br />WHEREAS, such Deed of Trust /Mortgage had a stated maturity date of October 1, 2013. <br />WHEREAS, Borrower has requested that Lender make an additional advance to be <br />secured by such existing Deed of Trust; <br />WHEREAS, Lender and Borrower have mutually agreed to renew and extend the <br />indebtedness secured by such Deed of Trust/Mortgage, <br />WHEREAS, Lender is willing to make an additional advance to be secured by such Deed <br />of Trust provided there shall have been no filings of record subsequent to the date of the <br />recording of that Deed of Trust hereinabove identified; <br />WHEREAS, Borrower and Lender hereby desire to amend the existing Deed of Trust <br />identified hereinabove to provide that it shall continue to secure the presently remaining <br />indebtedness and the additional advance and future advances from and after the date hereinafter <br />specified; <br />NOW, THEREFORE, in consideration of such renewal and extension, the parties hereto <br />give notice in accord with NEB. REV. STAT. SS 76 -239 of the continued effectiveness of the <br />Deed of Trust /Mortgage above described in the following respects: <br />1. Incorporation of Future Advance Rights. From and after the date of the execution <br />of this Deed of Trust Modification Agreement, the indebtedness secured by the Deed of Trust <br />described hereinabove shall secure advances made concurrently herewith and future advances in <br />accordance with the following provision which shall hereafter be deemed to be a part of such <br />Deed of Trust: <br />Future Advances.
