This instrument, made this %%--day of December 2003, between Eric H. Lindquist, a member of the
<br />Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor ", pursuant to a power of sale
<br />contained in that certain Deed of Trust recorded on November 1, 2000 as Document No. 200009533 and re-
<br />recorded on December 4, 2000 as Document No. 200010475 of the Mortgage Records in the office of the
<br />Register of Deeds of Hall County, Nebraska, and U.S. Bank National Association N.D., hereinafter called
<br />"Grantee ":
<br />WHEREAS, on September 3, 2003, Eric H. Lindquist, as Successor Trustee, executed a Notice of
<br />Default pursuant to which notice was given to Deborah Sporn, a single person, and Colleen K. Wagner and
<br />Michael C. Wagner, wife and husband, Trustors, under that certain Deed of Trust recorded on November 1,
<br />2000 as Document No. 200009533 and re- recorded on December, 4, 2000 as Document No. 200010475 of
<br />the Mortgage Records in the office of the Register of Deeds of Hall County, Nebraska, covering that certain
<br />premises described as:
<br />PART OF THE SE 1/4 SW1 /4 NE 1/4 OF SECTION 10, IN TOWNSHIP 11 NORTH, RANGE 9,
<br />WEST OF THE 6TH P.M., HALL COUNTY, NEBRASKA, MORE PARTICULARLY
<br />DESCRIBED AS FOLLOWS: COMMENCING AT THE SOUTHEAST CORNER OF THE EI /2
<br />SWIA NEI /4 OF SAID SECTION THENCE NORTH 132 FEET, THENCE WEST FOR A
<br />DISTANCE OF 100 FEET; THENCE SOUTH FOR A DISTANCE OF 132 FEET; THENCE
<br />EAST FOR A DISTANCE OF 100 FEET TO THE PLACE OF BEGINNING. ALSO
<br />COMMENCING AT A POINT 132 FEET NORTH OF THE SOUTHEAST CORNER OF THE
<br />E1 /2 SW1 /4 NE 1/4 OF SECTION 10, TOWNSHIP I1 NORTH, RANGE 9 WEST OF THE 6TH
<br />P.M., RUNNING THENCE NORTH 132 FEET; RUNNING THENCE WEST 300 FEET;
<br />RUNNING THENCE SOUTH 132 FEET; RUNNING THENCE EAST 300 FEET TO THE
<br />PLACE OF BEGINNING,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting forth the
<br />nature of such breach and of his election to sell or cause to be sold such property to satisfy the obligation.
<br />Said Notice of Default was filed for record in the Office of the Register of Deeds of Hall County, Nebraska,
<br />on September 5, 2003 as Instrument No. 200311858 of the Miscellaneous Records of said County.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice pursuant to
<br />said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Subsequent thereto, beginning on October 30, 2003, Grantor caused to be published in the Grand
<br />Island Daily Independent, a newspaper having a general circulation in Hall County, Nebraska, a Notice of
<br />Trustee's Sale setting forth a description of the property to be sold and stating that the described property
<br />would be sold at public auction to the highest bidder for cash or certified or cashier's check, at the lower
<br />level lobby of the Hall County Courthouse, Is` & Locust Street, Grand Island, Hall County, Nebraska, at
<br />10:00 a.m. on December 11, 2003. Publication of such notice was made for five consecutive weeks on
<br />October 30, 2003, November 6, 2003, November 13, 2003, November 20, 2003 and November 27, 2003, the
<br />last publication being at least ten (10) days but not more than thirty (30) days prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties entitled to
<br />notice pursuant to said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Pursuant to said Notice of Trustee's Sale, John B. McDermott, attorney for Eric H. Lindquist,
<br />Successor Trustee, did at the time and place mentioned in said Notice of Trustee's Sale, offer said property
<br />for sale at public auction, and did sell the same to Grantee for the sum of $42,415.00, it being the highest
<br />bidder therefor.
