Kivett, Attorney at Law duly licensed to practice in the State of Nebraska, <br />Trustee, in the exercise of the power of sale conferred upon him, does hereby execute and deliver this <br />indenture, <br />WITNESSETH THAT: <br />WHEREAS, for a valuable consideration on October 4, 1999, Caroline T. Carson n /k/a Caroline <br />T. Buettner and Randall L. Buettner, as joint tenants with right of survivorship, Trustors, executed and <br />delivered their Deed of Trust to Michael F. Kivett, as Trustee, and Citicorp Trust Bank, fsb f/k/a <br />Travelers Bank & Trust, FSB, as Beneficiary, conveying the real estate hereinafter described in trust, <br />with power of sale, in accordance with the terms and provisions set forth therein; that said Deed of Trust <br />was thereafter recorded on October 14, 1999 in the office of the Register of Deeds of Hall County, <br />Nebraska as noted as Instrument No. 0099110001; and <br />WHEREAS, the Trustors having defaulted in the payment of the indebtedness secured thereby <br />and the Beneficiary having delivered to the Trustee a written declaration of default and having deposited <br />with the Trustee all promissory notes together with Notice of Default; and <br />WHEREAS, in compliance with Sec. 76 -1006, Statutes of Nebraska, on the 6th day of March, <br />2003 the Trustee filed a Notice of Default in the office of the Register of Deeds of Hall County, <br />Nebraska, as noted as Instrument No. 0200302683, which Notice fully complied with the requirements of <br />said statute; and <br />WHEREAS, in compliance with Sec. 76 -1008, Statutes of Nebraska, on the 13th day of March, <br />2003, the Trustee mailed by certified mail, with postage prepaid, a copy of such Notice of Default with <br />the recording date shown thereon, addressed to the following interested parties, to -wit: <br />Randall L.
