This <br />Deed of Trust was recorded April 15, 1998 in the Records of the Register of Deeds of Hall County, <br />Nebraska as Instrument No. 98- 103512. <br />On or about April 15, 1998, United Nebraska Bank, Beneficiary, assigned all of its right, title <br />and beneficial interest in the Deed of Trust to Commercial Federal Mortgage Corporation. The <br />Assignment was recorded April 15, 1998, in the office of the Register of Deeds of Hall County, <br />Nebraska, as Instrument No. 98- 103513. <br />Hereinafter the Trustee, Commercial Federal Bank, a Federal Savings Bank, will be referred to <br />as GRANTOR. <br />The GRANTOR in consideration of Sixty -Eight Thousand Nine Hundred Ninety -Five <br />Dollars and Forty -Seven Cents ($68,995.47) and other valuable consideration received from <br />Commercial Federal Bank, a Federal Savings Bank, successor to Commercial Federal Mortgage <br />Corporation, hereinafter GRANTEE, does hereby grant, bargain, sell, convey and confirm unto <br />GRANTEE the following described real property in Hall County, Nebraska: <br />The West One Third (W1 /3) of Lots Five (5) and Six (6), in Block Seven (7) in Hann's <br />Third Addition to the City of Grand Island, Hall County, Nebraska, being a <br />rectangular tract of ground having a South frontage of Fifty -Three (53) feet and Eight <br />(8) inches on Charles Street in said City, and a depth of One Hundred and Six (106) <br />feet, together with a right of way easement over and across the North Ten (10) Feet of <br />the West One Third (WI /3) of said Lot Five (5) for driveway purposes <br />To have and to hold the above - described premises together with all tenements, hereditaments and <br />appurtenances thereto belonging unto the GRANTEE, and to the GRANTEE'S successors and assigns <br />forever. <br />GRANTOR does hereby covenant with the GRANTEE and with the GRANTEE'S successors <br />and assigns: <br />(1) That Jose V. Torres and Jennifer E. Torres, as husband and wife, as Trustors, failed to <br />pay the Beneficiary payments which were contractually due, and the GRANTOR, at the request of the <br />Beneficiary, elected to declare the entire unpaid principal balance, together with interest thereon, at once <br />immediately due and payable. <br />(2) That a Notice of Default was recorded by GRANTOR on April 7, 2003, as Instrument <br />No. 2003 - 04114, in the records of the Register of Deeds, Hall County, Nebraska. Within ten (10) days <br />thereafter, a copy of the recorded Notice of Default was mailed by certified mail, postage prepaid, to all <br />parties entitled to notice, pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. § 76- <br />1008 (Reissue 1996). <br />(3) That Trustors, Jose V. Torres and Jennifer E.
