<br />Pursuant to Article 10 of Chapter 76 of the Revised Statutes of Nebraska, notice is hereby given of a
<br />default by Thomas Trejo and Rose J. Trejo, husband and wife (whether one or more, collectively the
<br />"Borrower "), under that certain Deed of Trust by and between said Borrower and American Pioneer Title
<br />Insurance Company as Trustee ( "Original Trustee "), and Beneficial Nebraska, Inc. d /b /a Beneficial Mortgage
<br />Co., as Beneficiary ( "Lender "), which said Deed of Trust was filed of record with the Hall County Register of
<br />Deeds on October 30, 2001, as Document No. 200111006. Per a Substitution of Trustee, Rick D. Lange, a
<br />member of the Nebraska State Bar Association ( "Trustee "), has been substituted for the Original Trustee as
<br />trustee. The trust property described in said Deed of Trust is the following:
<br />A tract of land 56 feet in width by 132 feet in length, formerly being a part of West Eleventh
<br />Street of the City of Grand Island, Hall County, Nebraska, vacated by said City of Grand Island
<br />on the 21s` day of June, 1961, by Ordinance No. 3688 of said City, which is more particularly
<br />described as follows: Beginning at the Northeast corner of Lot 5, in Block 14 of West Park
<br />Addition to the City of Grand Island, Nebraska; thence running West on the North line of said
<br />Lot 5 for a distance of 132 feet to the Northwest corner of said Lot 5; thence running North on
<br />a prolongation of the West line of said Lot 5 for a distance of 56 feet; thence running East
<br />parallel to the North line of said Lot 5 for a distance of 132 feet to a point on the East line of
<br />said Lot 5 if the same were extended to the North; thence running South on a prolongation of
<br />the East line of said Lot 5 for a distance of 56 feet to the Northeast corner of said Lot 5, being
<br />the point of beginning
<br />Breaches of obligations for which the above - described trust property was conveyed as security have
<br />occurred inasmuch as the Borrower has failed to pay monthly principal and interest payments that were due
<br />pursuant to the terms of said Deed of Trust and Promissory Note referred to therein (the "Note "). The
<br />indebtedness under the Note and secured by the Deed of Trust has been accelerated and Borrower is liable to
<br />Lender for the full amount of all principal and interest under the Note, plus all future interest per the terms of
<br />the Note, plus all other fees, costs, and expenses to which Lender is entitled under the said Deed of Trust, the
<br />Note, and /or applicable law. Borrower is hereby notified that Borrower has the right to (a) reinstate the
<br />obligation secured by the Deed of Trust by making timely payments in accordance with the terms of Neb. Rev.
<br />Stat. § 76 -1012, and (b) bring a court action to assert the nonexistence of a default or any other defense of
<br />Borrower to acceleration and sale.
<br />Pursuant to the terms of the said Deed of Trust and Article 10 of Chapter 76 of the Revised Statutes of
<br />Nebraska, Trustee, at the instruction of Lender, has elected to sell or cause the above - described trust property
<br />to be sold to satisfy the Borrower's obligations to the Lender under said Deed of Trust.
