Casto, husband and wife, Grantor, in lieu of foreclosure and <br />waiver of any deficiency, convey unto Bank of Clarks, Grantee, the following described real estate <br />as: <br />The East One -Half (E' /2) of Fractional Lot Three (3) and the West Twenty -Four <br />Feet (24') of Lot Two (2) in Block One Hundred and One (101) in Railroad <br />Addition to the City of Grand island, Hall County, Nebraska <br />together with all buildings, improvements, fixtures, and appurtenances located thereon. <br />Grantors covenant with Grantee that Grantors are lawfully seized of such real estate and that <br />the real estate is free from encumbrance, except encumbrances of record; have legal power and <br />lawful authority to convey the real estate. <br />Non-Merger- Grantors and Grantee acknowledge and agree that this Deed in Lieu of <br />Foreclosure does not merge the fee simple title of the real estate with the lienhold interest of Bank <br />of Clarks by reason of a Deed of Trust on the above described property and recorded at the Register <br />of Deeds office of Hall County, Nebraska on May 17, 2001 as instrument No. 0200104599. It is <br />the Bank's intention to hold the fee simple title subject to Bank's own liens against the real estate <br />and to retain all rights of a secured creditor with respect to the property including, but not limited <br />to, the right to commence a judicial foreclosure.
