<br />PARTIAL RELEASE OF CONSTRUCTION LIEN
<br />Power Engineers, Inc. ( "Power Engineers ") recorded a Construction Lien on July IS,
<br />2003 in the office of the Hall County Register of Deeds, Document No. 0200309193
<br />( "Construction Lien ") which was indexed against the following described real property:
<br />The NE1 /4 of Section 23, Township 12 North, Range 12,West of
<br />the 6th P.M., Hall County, Nebraska, excepting the parcel
<br />referenced in the Warranty Deed filed as Document Number
<br />200300072 filed on January 6, 2003 with the Hall County Register
<br />of Deeds (the "Property ").
<br />Power Engineers hereby releases all claims, liens, rights, title and interest it may have arising out
<br />of the Construction Lien with respect to the Property, EXCEPT for any claims, liens, rights, title
<br />and interest Power Engineers may have with respect to any right, title, interest, lien, easement,
<br />use rights, franchise rights, or permits owned or held by Touch America, Inc. and /or AT &T
<br />Corp., AT &T Communications of the Midwest, Inc. and their associated and allied companies
<br />(defined to include American Telephone and Telegraph Company, its parents and subsidiaries) in
<br />and to the Property.
<br />This release is not intended to, and does not release any right, title or interest Power Engineers
<br />has by virtue of the Construction Lien with respect to any other real property described in the
<br />Construction Lien.
