<br />This instrument, made thisl�)3 day of July, 2003 between Eric H. Lindquist, a member of
<br />the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor ", pursuant to a
<br />power of sale contained in that certain Deed of Trust recorded on September 7, 2001 as Document
<br />No. 200109082 of the Mortgage Records in the office of the Register of Deeds of Hall County,
<br />Nebraska, and Secretary of the Department of Housing and Urban Development, hereinafter called
<br />"Grantee":
<br />WHEREAS, on April 24, 2003, Eric H. Lindquist, as Successor Trustee, executed a Notice
<br />of Default pursuant to which notice was given to Edilberto Lopez Zuniga and Bernadette J.
<br />Alvarado Lopez, husband and wife, Trustors, under that certain Deed of Trust recorded September
<br />7, 2001 as Document No. 200109082 of the Mortgage Records in the office of the Register of
<br />Deeds of Hall County, Nebraska, covering that certain premises described as:
<br />THE SOUTH FORTY -FIVE (45) FEET OF LOT FOUR (4), IN BLOCK ONE (1),
<br />HEYDE' S ADDITION TO GRAND ISLAND, HALL COUNTY, NEBRASKA,
<br />ACCORDING TO THE RECORDED PLAT THEREOF,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of their election to sell or cause to be sold such property to
<br />satisfy the obligation. Said Notice of Default was filed for record in the Office of the Register of
<br />Deeds of Hall County, Nebraska on April 29, 2003 as Instrument No. 0200305227 of the
<br />Miscellaneous Records of said County.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Subsequent thereto, beginning on June 9, 2003, Grantor caused to be published in The
<br />Grand Island Daily Independent, a newspaper having a general circulation in Hall County,
<br />Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and stating
<br />that the described property would be sold at public auction to the highest bidder for cash or certified
<br />or cashier's check, at the lower level lobby of the Hall County Courthouse, 1St & Locust Street,
<br />Grand Island, Hall County, Nebraska at 10:00 a.m. on July 22, 2003. Publication of such notice
<br />was made for five consecutive weeks on June 9, 2003, June 16, 2003, June 23, 2003, June 30, 2003
<br />and July 7, 2003, the last publication being at least ten (10) days but not more than thirty (30) days
<br />prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to noti--e pursuant to said Deed of Trust and in compliance with Section 76 -1008
<br />R.R.S. Nebraska.
<br />Pursuant to said Notice of Trustee's Sale, John B. McDermott, attorney for Eric H.
<br />Lindquist, Successor Trustee, did at the time and place mentioned in said Notice of Trustee's Sale,
<br />offer said property for sale at public auction, and did sell the same to MidFirst Bank for the sum of
<br />$84,142.40, it being the highest bidder therefor. MidFirst Bank has assigned,all of its right, title,
<br />and interest in and to such bid to Grantee.
