200314535 <br />EASEMENT <br />For good and valuable consideration, receipt of which is hereby acknowledged, <br />Grantors, Chris Mitchell and Anita Mitchell, husband and wife, owner of the following <br />described property: <br />Lot 1, Platte River Drive subdivision, Hall County, Nebraska <br />which property is referred to herein as the "Servient Estate ", conveys a perpetual easement to <br />W.B.W. Family Limited Partnership, Grantee, and its successors and assigns, for the purpose of <br />permitting Grantee's irrigation systems to cross over a portion of the Servient Estate described as <br />follows: <br />"East 20 feet, the north 20 feet and the west 20 feet respectively <br />along the east, north and west lot lines of Lot 1 Platte River Drive <br />Subdivision Hall County, Nebraska. <br />The above described Easement shall be perpetual and shall be appurtenant to the <br />Dominant Estate, and shall run with the land. Grantors for themselves their successors assigns <br />covenant that this will erect no fences or barriers or permit any other obstructions which interfere <br />with the use and enjoyment of the easement granted herein. <br />The Dominant Estate is described as follows: <br />Section 30, Township 9, North Range 11 West of the 6t" P.M. in <br />Hall County, Nebraska except that portion the Northwest Quarter <br />of Section 30 constituting the Servient Estate. <br />Grantors further grant to Grantees and their successors and assigns an agriculture use <br />easement by which Grantees Dominant Estate may be used in perpetuity as agriculture land for <br />uses including crop and livestock production and feeding. <br />The Easements and Covenants contained herein shall be binding upon the successors and <br />assigns of the parties as fully as upon the parties themselves and shall run with the title to the <br />Servient Estate and the Dominant Estate. <br />Dated this �r day of November, 2003 <br />" I � 4- A 7-7'-- � <br />Chris Mitchell, Grantor <br />Anita Mitchell, Grantor <br />
