Vipperman, <br />and adduces evidence. Respondent was not present in Court, but was represented by his <br />attorney, James Wentz. The Court, being fully advised in the premises, finds as follows: <br />1. Petitioner and Respondent were residents of the State of Nebraska for more than <br />one year prior to the filing and the Petitioner was a resident of Hall County at the time of <br />the filing herein. <br />2. The Respondent was served a Summons by the Sheriff of Hamilton, County, <br />Nebraska. The Court finds, pursuant to Neb. Rev. Stat. §42 -363 (Reissue 1998), that <br />more than sixty days have passed since the perfection of service of process upon the <br />Respondent. <br />3. The Court has jurisdiction over both parties and over the subject matter of this <br />action and to make a child custody determination. <br />4. Petitioner is not a party to any other pending actions for divorce, separation, or <br />dissolution of marriage. <br />5. The marriage of Petitioner and Respondent is irretrievably broken, and every <br />reasonable effort to effect reconciliation has been made. <br />6.
