Kivett, Attorney at Law duly licensed to practice in the State of Nebraska, <br />Trustee, in the exercise of the power of sale conferred upon him, does hereby execute and deliver this <br />indenture, <br />WITNESSETH THAT: <br />WHEREAS, for a valuable consideration on June 28, 2002, Ramon Perez a/k/a Ramon Perez - <br />Rodriguez a/k/a Ramon Perez - Rodrigues, a single person, Trustor, executed and delivered his Deed of <br />Trust to Michael F. Kivett, as Trustee, and CitiFinancial, Inc. (MD), as Beneficiary, conveying the real <br />estate hereinafter described in trust, with power of sale, in accordance with the terms and provisions set <br />forth therein; that said Deed of Trust was thereafter recorded on July 2, 2002 in the office of the Register <br />of Deeds of Hall County, Nebraska as noted as Instrument No. 0200206984; and <br />WHEREAS, the Trustor having defaulted in the payment of the indebtedness secured thereby <br />and the Beneficiary having delivered to the Trustee a written declaration of default and having deposited <br />with the Trustee al I promissory notes together with Notice of Default; and <br />WHEREAS, in compliance with Sec. 76 -1006, Statutes of Nebraska, on the 6`h day of August, <br />2003, the Trustee filed a Notice of Default in the office of the Register of Deeds of Hall County, <br />Nebraska, as noted as Instrument No. 0200310244, which Notice fully complied with the requirements of <br />said statute; and <br />WHEREAS, in compliance with Sec. 76 -1008, Statutes of Nebraska, on the 121' day of August, <br />2003, the Trustee mailed by certified mail, with postage prepaid, a copy of such Notice of Default with <br />the recording date shown thereon, addressed to the following interested parties, to -wit: <br />Ramon Perez <br />a/k/a Ramon Perez- Rodriguez <br />810 North Pine <br />Grand Island NE 68801 <br />which mailing of notice fully complied with the requirements of said statute; and <br />WHEREAS, in compliance with Sec. 76 -1007, Statutes of Nebraska, the Trustee gave written <br />notice of the time and place of sale particularly describing the property to be sold by publication of such <br />notice, commencing on September 10, 2003 and continuing once each week for five (5) consecutive <br />weeks, the last publication being at least ten (10) days but not more than thirty (30) days prior to the date <br />co <br />N � <br />o <br />CD CL <br />W D <br />N CD <br />CD <br />Z <br />O <br />s <br />s <br />G <br />
