The parties recite and declare that:
<br />A. FIVE POINTS BANK is the owner and holder of a certain Mortgage dated January 8,
<br />1997, and filed in the Register of Deeds Office of Hall County, on January 14, 1997, as Document
<br />No. 97- 100235 of that County, covering, the following described property:
<br />LOT 2, PARK -VIEW SECOND SUBDIVISION, GRAND ISLAND, HALL COUNTY, NEBRASKA, AND: A
<br />TRACT OF LAND COMPRISING A PART OF LOT 1, PARK -VIEW SECOND SUBDIVISION IN THE CITY
<br />OF GRAND ISLAND, HALL COUNTY, NEBRASKA, AND MORE PARTICULARALY DESCRIBED AS
<br />FOLLOWS: BEGINNING AT THE SOUTHWEST CORNER OF SAID LOT l; THENCE NORTHERLY
<br />ALONG AND UPON THE WEST LINE OF SAID LOT 1, A DISTANCE OF 59.0 FEET, THENCE EASTERLY
<br />PARALLEL WITH THE SOUTH LINE OF SAID LOT 1, A DISTANCE OF 94.46 FEET TO A POINT ON THE
<br />PROLONGATION OF THE EAST LINE OF LOT 2, PARK -VIEW SECOND SUBDIVISION: THENCE
<br />SOUTHERLY A DITANCE OF 59.0 FEET TO A POINT ON THE SOUTH LINE OF SAID LOT 1, ALSO
<br />BEING THE NORTHEAST CORNER OF SAID LOT 2; THENCE WESTERLY ALONG AND UPON THE
<br />SOUTH LINE OF SAID LOT 1, A DISTANCE OF 94.20 FEET TO THE POINT OF BEGINNING.
<br />B. LENDER is about to loan the sum of Sixty Thousand Dollars and No Cents
<br />($60,000.00) on a Note and Deed of Trust securing such Note to be filed against the above described
<br />property.
<br />C. To induce LENDER to make such loan, it is necessary that the Mortgage held by FIVE
<br />POINTS BANK, described in Section A above, be subordinated to the lien of the Deed of Trust about
<br />to be made in favor of the LENDER as beneficiary as set forth above as it applies to the above
<br />described property only.
<br />For the reasons set forth above, and consideration of the mutual covenants and promises of the
<br />parties hereto, FIVE POINTS BANK and LENDER covenant and agree as follows:
<br />Subordination. FIVE POINTS BANK hereby covenants, consents and agrees
<br />with LENDER that the above - mentioned Mortgage is and shall continue to be subject to and
<br />subordinate in lien to the lien of the Deed of Trust about to be made to LENDER stated above.
