<br />"fhis instrument, made this Gi day of October, 2003, between Eric H. Lindquist, a member
<br />of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor ", pursuant to
<br />a power of sale contained in that certain Deed of Trust recorded on November 2, 2001 as
<br />Instrument No. 2001 -11175 of the Mortgage Records in the office of the Register of Deeds of Hall
<br />Comity, Nebraska, and Centex Home Equity Company, L.L.C., hereinafter called "Grantee ":
<br />WHEREAS, on July 3, 2003, Eric H. Lindquist, as Successor Trustee, executed a Notice of
<br />Default pursuant to which notice was given to Connie E. Leth and Kent E. Leth, wife and husband,
<br />Trustors, under that certain Deed of Trust recorded on November 2, 2001 as Instrument No. 2001 -
<br />t 1175 of the Mortgage Records in the office of the Register of Deeds of Hall County, Nebraska,
<br />covering that certain premises described as:
<br />THE WESTERLY FIFTY FEET (50) OF LOT EIGHT (8), IN BLOCK TWENTY -
<br />THREE (23), IN RUSSEL WHEELER'S ADDITION TO THE CITY OF GRAND
<br />ISLAND, HALL COUN'T'Y, NEBRASKA,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />}L:Il Ce : :nty, NeS:,-ska, on July 7, 2003 as instrument No. 2003 -08586 of the Miscellaneous
<br />Records of said County.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Subsequent thereto, beginning on August 28, 2003, Grantor caused to be published in the
<br />Grand Island Daily Independent, a newspaper having a general circulation in Hall County,
<br />Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and stating
<br />that the described property would be sold at public auction to the highest bidder for cash or certified
<br />or cashier's check, at the lower level lobby of the Hall County Courthouse, 1't & Locust Street,
<br />Grand Island, Hall County, Nebraska, at 10:00 a.m. on October 9, 2003. Publication of such notice
<br />was made for five consecutive weeks on August 28, 2003, September 4, 2003, September 11, 2003,
<br />September 18, 2003 and September 25, 2003, the last publication being at least ten (10) days but
<br />not more than thirty (30) days prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76 -1008
<br />R.R.S. Nebraska.
<br />Pursuant to said Notice of Trustee's Sale, John B. McDermott, attorney for Eric II.
<br />Lindquist, Successor Trustee, did at the time and place mentioned in said Notice of Tmstee's Sale,
<br />offer said property for sale at public auction, and did sell the same to Grantee for the sum of
<br />$83,950.M it being the highest bidder therefor.
