WICK et. al., Defendants, <br />at the 2003 regular term of said Court, FUNDCO, INC. did obtain a Decree of Foreclosure finding that there is due <br />from The Estate of Earl C. Wick, et. al., to Fundco, Inc. for principal, interest, and costs the total sum of Three <br />Thousand Two Hundred Forty Nine Dollars and Twenty -seven Cents ($3,249.27) plus additional interest from <br />5/14/01 at the rate of Seventy -two Cents ($.72) per day; and <br />WHEREAS, it was then and there further ordered in said action that in default of the payment of the sum so <br />found due by the said Hall County District Court that Jerry Watson, Sheriff of Hall County, Nebraska, should cause <br />the lands and tenements hereinafter described to be advertised and sold according to law to pay the same; and <br />WHEREAS, default having been made therein, the said Jerry Watson, Sheriff of said County of Hall, under <br />and by virtue of the said Decree of Foreclosure and Order of Sale to him duly directed, did, on the 13th day of <br />August, 2003, at the Hall County Courthouse in the City of Grand Island, Nebraska, having first given due and legal <br />notice of the time and place of said sale by publication as required by law in the Grand Island Independent, a <br />newspaper printed and in circulation in said County of Hall, State of Nebraska, sell said premises at public auction <br />to Encinger Properties, L.L.0 for the sum of Four Thousand Six Hundred Dollars ($4,600.00), which sale was <br />afterward, at the 2003 regular term of said Court, examined and confirmed, and the said Jerry Watson, as such <br />Sheriff, required to convey the said premises in fee simple to the said Encinger Properties, L.L.C.. <br />NOW, THEREFORE, I, the said Jerry Watson, Sheriff of the Count of Hall as aforesaid, in consideration of <br />the premises and by virtue of the powers vested in me by law and the Decree of said Court, do hereby give, grant, <br />and convey to the said Encinger Properties, L.L.C., its heirs and assigns, the premises so as aforesaid sold, the <br />following described property, to -wit: Block One (1) <br />Lots Eight (8) and Nine (9yof Pleasant Hill Addition to the City of Grand Island, Hall County, <br />Nebraska; <br />with all appurtenances thereto. <br />TO HAVE AND TO HOLD THE SAME unto the said Encinger Properties, L.L.C., its heirs and assigns, and <br />to it and its use forever. <br />IN TESTIMONY WHEREOF, I have, as such Sheriff, hereunto set my hand this 2' to day of <br />October, 2003. <br />JERRY ATS <br />She of Hall County, Nebraska <br />Executed and delivered in the presence of <br />STATE OF NEBRASKA ] <br />]ss <br />COUNTY OF HALL ] <br />On this 8 710 day of October, 2003, before me, the undersigned, in <br />and for said county, personally appeared the said Jerry Watson, Sheriff of Ha Coun y, Nebraska, to me personally <br />known to be the identical person who signed the foregoing instrument as Grantor, and he acknowledged the same <br />to be his voluntary act and deed, as such sheriff, for the uses and purposes therein set forth. <br />(Seal) <br />WITNESS my hand and official seal the day and year above written. <br />I X7 <br />Notary Public <br />BONNIE L ARNOLD <br />MY COMMISSION EXPFB <br />March 15, 2005 <br />
