(n <br />o srn <br />rn `" d D w )_, <br />za r n C.) <br />3 <br />rV CD <br />C.n Cn <br />Cdr Z <br />200313130 <br />Deed of Trust Subordination Agreement <br />This Agreement is made this 26th day of September, 2003 by and between <br />BankFirst ( "Lender ") and <br />Heritage Bank ( "Bank") <br />Lender is the beneficiary under a Deed of Trust granted by Rodney M Peters and <br />Rhonda S Peters Husband and Wife, as Joint Tenants, Trustors to BankFirst Dated <br />July 18, 2003 and recorded in the office of the Register of Deeds, <br />Hall County, Nebraska on July 25, 2003 as Instrument # 200309583 <br />encumbering the real property described therein (collectively, the "Property "). `Bank" is <br />the beneficiary under a Deed of Trust dated July 18 , 2003 and recorded in the same <br />office on August 4 , 2003 as Instrument # 200310073, encumbering the property <br />described herein. To induce "Bank" to make a first lien to the Borrower secured by their <br />Deed of Trust, "Lender" has agreed to execute and deliver this Subordination Agreement. <br />ACCORDINGLY, in consideration of the premises and for other good and valuable <br />consideration, the receipt and sufficiency of which are hereby acknowledged, "Lender" <br />hereby agrees with "Bank" that the lien of the BankFirst Deed of Trust on the Property is <br />and shall be and remain fully subordinate for all purposes to the lien of the Heritage Bank <br />Deed of Trust on the Property, to the full extent of all sums from time to time secured by <br />said Deed of Trust; provided, however, that the total indebtedness secured by the Heritage <br />Bank Deed of Trust does not exceed $ 135,000.00 exclusive to interest thereon, <br />amounts advanced to protect the lien and priority of said Deed of Trust, and costs of <br />collection. <br />LEGAL DESCRIPTION: <br />Lot 1, R & R Peters Subdivision, Hall County, Nebraska. <br />A.P.N. #: 400448599 <br />IN WITNESS THEREOF, this Subordination Agreement is executed on the day and year <br />first above stated. <br />.rW"'a PKFirs� BankFirst <br />1pCp6p8HAifB By: <br />Anne all, Community President <br />)),s'!4:�Z4440 0 SEAL c <br />State of Nebraska �S.
