<br />KNOW ALL MEN BY THESE PRESENTS:
<br />THAT WHEREAS, in an action found at Case No. Cl 02 -1195 in the District Court
<br />of Hall County, Nebraska, wherein First Union National Bank of North Carolina, as
<br />Trustee for the registered holders of Emergent Home Equity Loan Pass Through
<br />Certificate Series 1997 -03, is the plaintiff, and Ralph E. Medcalf, Janis M. Medcalf, a /k/a
<br />Janis M. Setsod, G.A.C., Trustee, Household Finance Corporation, Assignee Beneficiary,
<br />Riverside Acres Property Owner's Association, and John Doe and Jane Doe, real names
<br />unknown, are the defendants, First Union National Bank of North Carolina, as Trustee for
<br />the registered holders of Emergent Home Equity Loan Pass Through Certificate Series
<br />1997 -03, did obtain a Decree finding that there is due the plaintiff the sum of One
<br />Hundred Ninety -Two Thousand Five Hundred Ninety -One Dollars and Five Cents
<br />($192,591.05), plus interest, escrow advances, title search costs and costs of suit; and
<br />WHEREAS, it was further ordered in said Decree that in default of the payment
<br />of the sum so found due by the defendants, that the appointed Master Commissioner
<br />should cause the lands and tenements hereinafter described to be advertised and sold
<br />according to law to pay the same; and
<br />WHEREAS, default in payment having been made therein, Arend R. Baack, Master
<br />Commissioner Linder and by virtue of the said Decree and the Order of Sale to him duly
<br />directed, did on July 15, 2003, inside the front door of the Hall County Courthouse, in the
<br />City of Grand Island, Hall County, Nebraska, having first given due and legal notice of the
<br />time and place of said sale by publication once in each week for four consecutive weeks in
<br />a newspaper printed and in general circulation in said County of Hall, sell said premises at
<br />public auction to Wachovia Bank, N.A., formerly known as First Union National Bank of
<br />North Carolina, for the sum of One Hundred Ninety -Five Thousand Dollars ($195,000.00);
