Krueger, being first duly sworn, upon oath deposes and says as follows, to wit: <br />Z <br />aq <br />1. On this date, he is a Registered Land Surveyor in the State of Nebraska. <br />O <br />2. Affiant further states that on December 2, 2002, he completed a survey of "LIVENGOOD SECOND <br />91 <br />d6 <br />SUBDIVISION' in the City of Grand Island, Nebraska, a plat thereof being recorded at the Register of <br />Deeds Office located in the Hall County Administration Building. <br />3. Affiant further states that he has this date re- examined the plat of said "LIVENGOOD SECOND <br />SUBDIVISION' and has discovered as error in the legal description in which a Condemnation Deed <br />recorded in the Register of Deeds Office as Document Number 200201704 was omitted. <br />4. Affiant further states that the Legal Description shall now read: <br />Lot One (1), Livengood Subdivision, in the City of Grand Island, Hall County, Nebraska and a tract of <br />land described in Document Number 96- 102516 of the Hall County Register of Deeds Office as <br />follows: <br />Part of the East Half of the Southeast Quarter (E 1 /2SE 1/4) of Section Ten (10), in Township Eleven <br />(11) North, Range Nine (9) West of the 6th P.M., in Hall County, Nebraska more particularly described <br />as follows: <br />Beginning at a point on the south line of said Section Ten (10) 180.63 feet west of the southeast corner <br />of said Section Ten (10); running thence north parallel to the east line of said Section Ten (10) for a <br />distance of 288.00 feet; running thence west parallel to the south line of said Section Ten (10) for a <br />distance of 107.00 feet; running thence south parallel to the east line of said Section Ten (10) for a <br />distance of 288.00 feet more or less to a point on the south line of said Section Ten (10); running <br />thence east upon and along the south line of said Section Ten (10) a distance of 107.00 feet to the point <br />of beginning containing 11.83 acres, EXCEPT a tract of land deeded to the State of Nebraska by <br />Condemnation and recorded in Document Number 200201704 in the Hall County Register of Deeds <br />Office leaving a balance of 9.86 acres. <br />Further Affiant Saith Not. <br />Dated this 0h day of September, 2003 <br />Thomas L.
