<br />Deed of Trust Subordination Agreement
<br />This Agreement is made this j-0 day of 7't-q, 2003 by avu3
<br />between Home Federal Savings and Loan Association, ( "Lender "), and Union Bank and
<br />''trust Company, ( "Refinancer ").
<br />Lender is the beneficiary under a Decd of Trust (the "Junior Deed of Trust ")
<br />executed by Joel Lee Aden and Kimberly Lynn Aden husband and wife, jointly and each
<br />in their own right, Trustors, to Hoge Federal Savings and Loan Association, Beneficiary,
<br />dated June 27, 2003 and recorded July 3, 2003 in the Register of Deeds Office in Hall
<br />County as Document No. 200308486, Nebraska, encumbering the real property described
<br />therein (collectively, the "Property "). Refinancer is the beneficiary under a Deed of Trust
<br />(the "Senior Deed of Trust ") dated 2003, and recorded in the sai -1e
<br />office on ? - -, 2003 in Book _ and Page =�
<br />encumbering the property, To induce Refinancer to snake a loan -to the Borrower secured
<br />by the Senior Decd of Trust, Lender has agreed to execute and deliver this Subordination
<br />Agreement.
<br />ACCORDINGLY, in consideration of the premises and for other good and
<br />valuable consideration, the receipt and sufficiency of which are hereby acknowledged,
<br />Lender hereby agrees with Re'financer that the liens of the Junior Deed of Trust on the
<br />Property is and shall remain fully subordinate for all purposes to the lien of the Senior
<br />Deed of Trust on the Property, to the full extent of all sums from Limo to time scoured by
<br />the Senior Deed of Trust; provided, however, that the total indebtedness secured by the
<br />Senior Deed of Trust does not exceed $47,000, exclusive to interest thereon, amounts
<br />advanced to protect the lien and priority of the Senior Deed of Trust, and costs of
<br />collection.
<br />LEGAL DESCRIPTION:
<br />The Easterly Seven feet (E7') of Lot Nine (9) and the Westerly Sixty -one
<br />feet (61') of Lot Fight (8), in Block One (1), Stewart- Place Subdivision
<br />being a part of the Northeast Quarter (NM/4) of Section Twenty -nine
<br />(29), Township Eleven (11), North, Range Nine (9), West of the G" P,M.
<br />in Hall County, Nebraska.
