<br />PREFACE TO MORTGAGE OR DEED OF TRUST UNDER o
<br />FARM HOMESTEAD PROTECTION ACT
<br />DISCLAIMER
<br />In accordance with the provisions of the Nebraska Farm Homestead Protection Act, the undersigned,
<br />RAYMOND BECKLER, as an individual, and EDWARD R. BECKLER and DORATHEA MAXINE
<br />BECKLER, husband and wife, prior to executing the attached Deed of Trust dated May 16, 2002, by and
<br />between the undersigned and THE STATE BANK OF CAIRO, A Nebraska Banking Corporation,
<br />(hereinafter referred to as "Mortgage ") hereby state and acknowledge:
<br />1. That no part of the homestead of the undersigned is presently, or in the future will be, situated on the
<br />following described real estate, (hereafter Parcel 1) nor are there any buildings sufficient to be designated
<br />as a homestead, presently located upon said Parcel 1:
<br />The South Half of the Southeast Quarter (S 1/2 SE 1/4) of Section Thirteen (13), Township Twelve (12) North, Range
<br />Twelve (12), West of the 6th P.M., except the right -of -way of the Chicago, Burlington and Quincy Railroad Company and
<br />except all that part of the said south half of the southeast quarter lying south and west of said railroad right -of -way containing
<br />1.8 acres conveyed by Travelers Insurance Company to Opal Piersol by Warranty Deed dated January 24, 1939, and except a
<br />certain tract described in deed recorded in Book 147 at page 15 of the official Hall County deed records, and except a tract of
<br />land described in deed recorded in Book 125 at page 257 of said deed records, and except a tract containing one acre, more or
<br />less, described in deed recorded as Document No. 76- 001425 and Document No. 76- 001426 of said official deed records;
<br />together with all that part of the south half of the southwest quarter that lies north and east of the right -of -way of the Chicago,
<br />Burlington and Quincy Railroad Company; both of said tracts being subject to existing roads, easements, rights -of -way and
<br />restrictions of record; and said two tracts containing a total of 92 acres more or less, and subject to one -half of the existing
<br />indebtedness against said premises in favor of the Federal Land Bank, except a tract of land described in Warranty Deed
<br />recorded as Document No. 77 -7008 of the official Hall County Deed records and except a tract of land described in Warranty
<br />Deed recorded as Document No. 98- 105826 of the official Hall County Deed records.
<br />2. The undersigned acknowledge that while the Mortgage or Deed of Trust remains unsatisfied and a lien on
<br />said Parcel 1, they shall have no right presently or in the future to make a designation of homestead on
<br />Parcel 1, including without limitation, in the event of a foreclosure or trustee's sale under the mortgage or
<br />Deed of Trust.
<br />3. The undersigned acknowledge that if, contrary to this Disclaimer, they establish a homestead on said Parcel
<br />1 during the time the Mortgage or Deed of Trust remains unsatisfied and a lien upon Parcel 1, they shall
<br />have no right to make a designation of homestead in the event of a foreclosure or trustee's sale under the
<br />Mortgage or Deed of Trust.
<br />4. The undersigned state that this acknowledgment is their knowing and voluntary act and deed and
<br />constitutes a written disclaimer and acknowledgment under the Nebraska Farm Homestead
<br />Protection Act and the undersigned do hereby disclaim any right to designate a homestead in the
<br />event of default upon such Mortgage or Deed of Trust or in the event of a foreclosure or trustee's
<br />sale under the Mortgage or Deed of Trust.
<br />5. The undersigned further understand and agree that this acknowledgment and Disclaimer shall be filed as a
<br />Preface to and become a part of the Mortgage or Deed of Trust.
