<br />consideration of ONE HUNDRED FIFTY 'I "HOUSAND DOLLARS ($150,000.00) AND OTHER GOOD 50
<br />AND VALUABLE CONSIDERATION, receipt of which is hereby acknowledged, does hereby convey to
<br />D & S PROPERTIES, INC., a Nebraska Corporation, Grantee, the following described real estate in Grand
<br />Island, Hall County, Nebraska:
<br />Unit 2838 in Island West Plaza Condominium Property Regime in the City of Grand Island, Hall
<br />County, Nebraska,
<br />together with all tenements, hereditaments, and appurtenances to the same belonging, and all the estate, title,
<br />interest, claim or demand whatsoever of said Grantor, of, in or to the same, or any part thereof; subject to
<br />easements and restrictions of record.
<br />Grantor covenants with the Grantee that Grantor:
<br />(1) is lawfully seized of such real estate and that it is free from encumbrances except as
<br />stated herein;
<br />(2) has good right and lawful authority to sell the same;
<br />(3) warrants and will defend the title to the real estate against the lawful claims of all persons.
<br />Grantee covenants with Grantor:
<br />(1) That Grantee will not sell the above- described property without having
<br />first offered the above - described property for sale to Grantor pursuant to
<br />paragraph 5 of a Contract for Sale entered into between Grantor and Grantee
<br />dated. September 12, 2005.
