Martinez, a single person as Trustor, <br />executed a Deed of Trust to Arend R. Baack, Attorney At Law, Trustee and Axis Capital, Inc., <br />Beneficiary, covering the following described real property, to wit: Lot 8, Block 3, Spaulding c <br />and Greggs Addition to the City of Grand Island, Hail County, Nebraska, which Deed of Trust <br />was in the original amount of $195,162.29 and was recorded on May 23, 2005 as Instrument No. <br />200504616 in the office of the Register of Deeds of Hall County, Nebraska, <br />WHEREAS, James A. Martinez, a single person, has applied for and received a loan in <br />the amount of $430,000.00 from Nebraska Economic Development Corporation/U.S. Small <br />Business Administration which loan amount is secured by a Deed of Trust on the <br />above - described real property filed on September 13, 2005, as Instxuznent Number 200508992; <br />and <br />WHEREAS, Arend R. Baack, Trustee and Axis Capital, Inc., Beneficiary, are agreeable <br />to subordinating the Deed of Trust first described above to the Deed of Trust of Nebraska <br />Economic Development Corporation/U.S. Small Business Administration. <br />NOW, THEREFORE IN CONSIDERATION OF THE PREMISES, and the making of <br />the loan by the aforesaid, and for valuable consideration, Arend R. Baack, Trustee, and Axis <br />Capital, Inc., Beneficiary, do hereby subordinate the Deed of Trust described above to the Deed <br />of Trust in favor of Nebraska Economic Development Corporation/U.S. Small Business <br />Administration in the amount of 5430,000.00 causing the lien of Arend R. Baack, Trustee, and <br />Axis Capital, Inc., Beneficiary, under the Deed of Trust described first above to be and remain at <br />all times subject, junior, and inferior to the Deed of Trust of Nebraska Economic Development <br />Corporation/U.S. Small Business Administration, which shall at all times be a prior, superior, <br />and paramount lien upon the above - described real estate- <br />19202 <br />
