<br />LIMITED WARRANTY DEED
<br />JOHN R. MENARD, an unmarried individual ( "Grantor "), in consideration of
<br />Ten. Dollars and other good and valuable consideration received from JAYHAWK
<br />INVESTMENTS 101, L.L.C. a Kansas limited liability company ( "Grantee "), conveys
<br />to Grantee the following described real estate in Grand Island, Hall County, Nebraska:
<br />LOT FIVE (5), MENARD SECOND SUBDIVISION, IN THE CITY OF GRAND
<br />ISLAND, HALL COUNTY, NEBRASKA.
<br />hereinafter referred to as the "Property."
<br />Together with all and singular the hereditaments and appurtenances thereunto
<br />belonging, or in anywise appertaining and remainders, and the revision and reversions,
<br />remainder, rents, issues and profits thereof: TO HAVE AND TO HOLD the said
<br />premises as above described, with the appurtenances, unto the Grantee forever.
<br />And the Grantor, for itself, and its successors, does covenant, promise and
<br />agree, to and with the Grantee, that it has not done or suffered to be done, anything
<br />whereby the said premises hereby granted are, or may be, in any manner encumbered or
<br />charged, except as herein. recited; and that the said premises, against all persons lawfully
<br />claiming, or to claim the same, by, through or under Grantor and none other, it WILL
<br />WARRANT AND DEFEND, subject to: general real estate taxes not yet due and
<br />payable; building and zoning laws; county and municipal ordinances; state and federal
<br />regulations; easements, covenants and restrictions of record; utility easements as shown
<br />on the plat of subdivision; Subdivision Agreement for Menard Second Subdivision
<br />recorded as Document No. 95- 105478; Storm Sewer Easement recorded as Document
<br />No. 200501598; and the following covenants which shall be recorded in the deed and
<br />Grantor shall reserve for its use, and the use of its successors or assigns, as an
<br />appurtenance to the Property:
<br />Site Development Approval: In order to insure that the area consisting of
<br />Grantor's adjacent property and the Property is developed and maintained
