V 1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth the terms and conditions under which Licensee may use the City's right -of -way: Placement of a monitoring well, required by the Nebraska Department of Environmental Quality, in the City's right of way near 1521 W. 2"d Street in Grand Island, Nebraska as shown on the attached drawing. Such monitoring well is labeled MW -8 on such drawing. Said monitoring well shall be flush with surrounding property, and will be located approximately thirty eight (38) feet east of the curb of Broadwell Avenue and approximately two (2) feet south of the north line of the alley. The exact placement of such monitoring well on the property identified above shall be coordinated with the Licensor's Public Works Department. The legal description of the property adjacent to where the monitoring well will be installed is E2/3 of Lot Two (2); all of Lots 3 & 4 of Block 18; Lots 1, 2, 3, and 4 of Block 17; and vacated Monroe Street, all in Kernoban and Decker's Addition to the City of Grand Island, Hall County, Nebraska. 2. CONTRACTOR'S DUTIES AND RISKS. It is understood and agreed that Licensee may construct, maintain, repair and utilize the above described improvement at the Licensee's sole risk. The Licensee hereby waives any claim for damages against the Licensor, its officers, employees, agents and independent contractors for any damage or injury that may result to said improvement.
