V <br />1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set <br />forth the terms and conditions under which Licensee may use the City's right -of -way: <br />Placement of a monitoring well, required by the Nebraska Department of <br />Environmental Quality, in the City's right of way near 1521 W. 2"d Street in <br />Grand Island, Nebraska as shown on the attached drawing. Such monitoring well <br />is labeled MW -8 on such drawing. Said monitoring well shall be flush with <br />surrounding property, and will be located approximately thirty eight (38) feet east <br />of the curb of Broadwell Avenue and approximately two (2) feet south of the <br />north line of the alley. <br />The exact placement of such monitoring well on the property identified above <br />shall be coordinated with the Licensor's Public Works Department. <br />The legal description of the property adjacent to where the monitoring well will <br />be installed is E2/3 of Lot Two (2); all of Lots 3 & 4 of Block 18; Lots 1, 2, 3, and <br />4 of Block 17; and vacated Monroe Street, all in Kernoban and Decker's Addition <br />to the City of Grand Island, Hall County, Nebraska. <br />2. CONTRACTOR'S DUTIES AND RISKS. It is understood and agreed that <br />Licensee may construct, maintain, repair and utilize the above described improvement at the <br />Licensee's sole risk. The Licensee hereby waives any claim for damages against the Licensor, its <br />officers, employees, agents and independent contractors for any damage or injury that may result <br />to said improvement.
