<br />This instrument, made this 6 day of September, 2005, between Eric H. Lindquist, a
<br />member of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor ",
<br />pursuant to a power of sale contained in that certain Deed of Trust recorded on April 9, 2003 as
<br />Instrument No. 0200304241 in the office of the Register of Deeds of Hall County, Nebraska, and
<br />CitiFinancial, Inc., hereinafter called "Grantee ":
<br />WHEREAS, on June 17, 2005, Eric H. Lindquist, as Successor Trustee, executed a Notice of
<br />Default pursuant to which notice was given to Joseph Manual Rivera and Dorothy Marie Rivera,
<br />husband and wife, Trustors, under that certain Deed of Trust recorded on April 9, 2003 as
<br />Instrument No. 0200304241 in the office of the Register of Deeds of Hall County, Nebraska,
<br />covering that certain premises described as:
<br />LOT 1, IN PARK -VIEW SECOND SUBDIVISION, GRAND ISLAND, HALL COUNTY,
<br />NEBRASKA, AND THE S1 /2 OF LOT 39, IN BLOCK "D ", PARKVIEW SUBDIVISION,
<br />AN ADDITION TO THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA,
<br />EXCEPTING A CERTAIN TRACT THEREFROM AS RECORDED IN SURVIVORSHIP
<br />WARRANTY DEED AS DOCUMENT NO. 87102613 AND EXCEPTING A CERTAIN
<br />TRACT THEREFROM AS RECORDED IN JOINT TENANCY WARRANTY DEED AS
<br />DOCUMENT NO. 87- 106566 ALSO EXCEPTING A CERTAIN TRACT THEREFROM
<br />AS RECORDED IN JOINT TENANCY WARRANTY DEED AS DOCUMENT NO. 87-
<br />106549,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on June 20, 2005 as Instrument No. 0200505528.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Subsequent thereto, beginning on July 23, 2005, Grantor caused to be published in the
<br />Grand Island Daily Independent, a newspaper having a general circulation in Hall County,
<br />Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and stating
<br />that the described property would be sold at public auction to the highest bidder for cash or certified
<br />or cashier's check, at the lower level lobby of the Hall County Courthouse, 15t & Locust Street,
<br />Grand Island, Hall County, Nebraska, at 2:00 p.m. on September 1, 2005. Publication of such notice
<br />was made for five consecutive weeks on July 23, 2005, July 30, 2005, August 6, 2005, August 13,
<br />2005 and August 20, 2005, the last publication being at least ten (10) days but not more than thirty
<br />(30) days prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76 -1008
<br />R.R.S. Nebraska.
