EASEMENT AGREEMENT 200508866 <br />THIS EASEMENT AGREEMENT is made and entered into this & day of August, 2005, <br />by and between Leonard Lamphear, single person, and Mary Ann Hettler and Larry Hettler, wife and <br />husband ( "Grantors ") and Dobesh harms, Inc., a Nebraska corporation ( "Grantee "). <br />RECITALS <br />WHEREAS, Grantors own the real estate legally described as the North Half of the Northeast <br />Quarter (Nl /2NEI /4) of Section thirty -five (35), Township Eleven (11) North, Range Eleven (11) <br />West of the 6thP.M., Hall County, Nebraska ( "the Grantor's Real Estate "); and <br />WHEREAS, Grantee is the owner of the real estate legally described as the South Half of the <br />Northeast Quarter (S1 /2NE1 /4) of Section Thirty -five (35), Township Eleven 911) North, Range <br />Eleven (11) West of the 6th P.M., Hall County, Nebraska ( "the Grantee's Real Estate "); <br />WHEREAS, Grantee has an easement of record involving the westerly thirty -six (36) feet <br />of the Grantor's Real Estate recorded as Document 484- 000126 on January 10, 1984; and <br />WHEREAS, Grantee leases the Grantor's Real Estate from Grantors, currently on a one year <br />lease commencing March 1, 2005 and ending March 1, 2006; and <br />WHEREAS, the parties desire to enter into this Easement Agreement. <br />IN CONSIDERATION of the mutual covenants and agreements of the parties, it is agreed <br />as follows: <br />1. Grantors hereby grant and convey to Grantee an easement for driveway purposes upon <br />and across a certain portion of Grantor's Real Estate, which easement shall exist for the benefit of <br />Grantee's Real. Estate. <br />2. "Driveway purposes" as used in this Agreement means the right to use as a means of <br />ingress and egress to and from the Grantee's Real Estate along driveways upon the Grantor's Real <br />Estate, as shown on attached Exhibit "A ". <br />3. The driveways and easement shown on Exhibit "A" shall be maintained by Grantee <br />at Grantee's expense. <br />This easement shall exist for the length of any lease of the Grantor's Real Estate herein <br />described to Grantee, and ends at the termination of the lease agreement and shall be binding and <br />inure to the benefit and detriment of the parties to this agreement, their respective heirs, successors <br />and assigns. <br />This constitutes the entire agreement of the parties. Any modification of this Agreement <br />shall be binding only if evidenced in writing and signed by each party. <br />
