<br />That a Deed of Trust was made and entered into on or about December 30, 1998, by and between William
<br />C. Peterson and Doris C. Peterson, husband and wife, as Trustors, and United Nebraska Bank, Beneficiary,
<br />wherein Commercial Federal Bank, a Federal Savings Bank, was named Trustee. This Deed of Trust was
<br />recorded December 31, 1998 in the Records of the Register of Deeds of Hall County, Nebraska as Instrument No.
<br />98- 1.13047. Said Deed of Trust was rerecorded to add Laura A. Peterson, a single person, as an additional Trustor
<br />to the Deed of Trust and said Deed of Trust was rerecorded on February 1, 1999, as Instrument No. 99- 101150.
<br />On or about December 30, 1998, United Nebraska Bank, Beneficiary, assigned all of its right, title and
<br />beneficial interest in the Deed of Trust to Commercial Federal Mortgage Corporation, The Assignment was
<br />recorded December 31, 1998, in the office of the Register of Deeds of Hall County, Nebraska, as Instrument No.
<br />98- 113048. Said Assignment was rerecorded on February 1, 1999, as Instrument No. 99- 101151.
<br />Hereinafter the Trustee, Commercial Federal Bank, a Federal Savings Bank, will be referred to as
<br />GRANTOR.
<br />The GRANTOR in consideration of Fifty -Six Thousand One Hundred Nineteen Dollars and Fifty -
<br />One Cents ($56,119.51) and other valuable consideration received from Wells Fargo Bank, N.A., successor in
<br />interest to Commercial Federal Bank, a Federal Savings Bank, successor to Commercial Federal Mortgage
<br />Corporation, hereinafter GRANTEE, does hereby grant, bargain, sell, convey and confirm unto GRANTEE the
<br />following described real property in Hall County, Nebraska:
<br />The Southerly Eighty -Nine and Five Tenths feet (589.5') of Lot Ten (10) in Block Sixteen
<br />(16) in H.G. Clark's Addition to the City of Grand Island, Hall County, Nebraska
<br />To have and to hold the above- described premises together with all tenements, hereditaments and
<br />appurtenances thereto belonging unto the GRANTEE, and to the GRANTEE'S successors and assigns forever.
<br />GRANTOR does hereby covenant with the GRANTEE and with the GRANTEE'S successors and
<br />assigns:
<br />(1) That William C. Peterson and Doris C. Peterson, husband and wife and Laura A. Peterson, a
<br />single person, as Trustors, failed to pay the Beneficiary payments which were contractually due, and the
<br />GRANTOR, at the request of the Beneficiary, elected to declare the entire unpaid principal balance, together with
<br />interest thereon, at once immediately due and payable.
<br />(2) That a Notice of Default was recorded by GRANTOR on April 26, 2005, as Instrument No.
<br />0200503712, in the records of the Register of Deeds, Hall County, Nebraska. Within ten (10) days thereafter, a
<br />copy of the recorded Notice of Default was mailed by certified mail, postage prepaid, to all parties entitled to
<br />notice, pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. § 76 -1008 (Reissue 2003).
<br />(3) That Trustors, William C. Peterson and Doris C. Peterson, husband and wife and Laura A.
<br />Peterson, a single person, failed to cure the default referenced in the Notice of Default within 30 days after the
<br />recording of the Notice of Default.
<br />(4) That a Notice of Trustee's Sale was executed by GRANTOR. At least twenty (20) days prior to
<br />the date of sale, a copy of the Notice of time and place of the Trustee's Sale was mailed by certified mail, postage
<br />prepaid, to all parties entitled to notice, pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. §
<br />76 -1008 (Reissue 2003).
<br />(5) GRANTOR published the Notice of Trustee's Sale, to be held on July 21, 2005 at 10:00 a.m., at
<br />the lower lobby of the Hall County Courthouse, 111 West First Street, Grand Island, Hall County, Nebraska,
<br />which notice was published in The Grand Island Independent of Grand Island, Nebraska, once a week for five (5)
