20050840'7 <br />Plaintiffs Motion for Default Judgment on his Petition for Declaratory Relief to <br />Quiet Title to Real Estate. <br />The Plaintiff appeared with his attorney and offered testimony and <br />Exhibits 1 through 71, inclusive, which were received into evidence. <br />No Defendant appeared, nor was any Defendant represented by counsel. <br />The Court, being advised and on the evidence presented, finds, determines <br />and orders as follows: <br />1. The Court has personal and subject matter jurisdiction of this <br />matter. <br />2. The Plaintiff filed a Petition on June 3, 2004, seeking ownership <br />rights in the described real estate pursuant to Neb. Rev. Stat. § 25- 21,150 (R.R.S. <br />1943, as amended), and a judicial decree quieting title to such real estate <br />pursuant to Neb. Rev. Stat. § 25- 21,112 (R.R.S.194,3, as amended). <br />3. Notice of the Petition was provided by formal publication in the <br />Grand Island Independent newspaper. <br />4. No appearance by any Defendant or counsel was entered. <br />5. The Plaintiff's Motion for Default Judgment, presented in open <br />Court this day, is granted; the relief requested and notice of hearing on the same <br />having been previously provided by formal publication in the Grand Island <br />Independent newspaper. <br />6. The Court hinds that the natural intent of the agreement entered <br />into by the Plaintiff and Defendants on April 21, 1966, and filed of record with the <br />Hall County Register of Deeds on January 1o, 1967, in Book 16 of Miscellaneous, <br />Page 17 -20, was to pass title to the subject real estate to the Plaintiff. <br />
