<br />AMENDMENT TO SUBDIVISION AGREEMENT
<br />VIA MILANO SUBDIVISION
<br />(Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, and 10 and Outlots A and B)
<br />This Amendment to the Via Milano Subdivision is between T.C. ENCK BUILDERS, INC., a
<br />Nebraska corporation, owner of such subdivision, and the CITY OF GRAND ISLAND,
<br />NEBRASKA, a municipal corporation.
<br />1. The Via Milano Subdivision Agreement was entered into on February 25, 2005, and
<br />recorded with the Hall County Register of Deeds on March 7, 2005, at Document No. 200501913.
<br />2. This amendment pertains to all lots in such subdivision.
<br />3. Paragraph No. 8 on Page 3 of the Via Milano Subdivision Agreement shall be
<br />amended to read as follows:
<br />8. Design and Construction. No building shall be constructed within the
<br />Subdivision except within the Building Envelope Areas as defined on the Development Plan
<br />(Exhibit "A" to the subdivision agreement). Roof eaves shall be allowed to encroach into a
<br />utility easement located on the same lot as the building by no more than one (1.0) foot. No
<br />buildings on adjoining lots shall be built closer than ten (10.0) feet from one another
<br />regardless of distance from the lot line. The buildings to be constructed (typical elevations
<br />shown on Exhibit "C" attached to the subdivision agreement ) shall be designed so that the
<br />exterior of such building shall be architecturally and aesthetically compatible in material and
